She saw a bridal gown she liked at a local bridal shop. She went in, tried it on and told the clerk she would come back because she wanted me to see it before she made a final decision. She asked me to go look at it and make a deposit to hold the gown if I liked it. I thought the dress was beautiful and told the clerk I wanted to make a deposit. The clerk told me that we would have to pay off the balance in six weeks. I agreed and made the down payment. In the meantime, my daughter found another dress that she liked better. When we went to cancel the first transaction, we were told that all sales are final. The clerk showed me where this was printed on my receipt. I argued that in Kansas there is a 72-hour or three-day cooling off period on all transactions. However, the clerk kept insisting that the "all sales are final" policy had been in effect as long as the shop had been in business. Attorney General Stovall, this shop apparently is unaware of the law or is violating it. We want to cancel this transaction, can you help us? Dear Kansas Consumer: My office is authorized to enforce the Kansas Consumer Protection Act (KCPA) which protects citizens from deceptive and unconscionable business practices by suppliers and servicers. However, suppliers are at liberty to establish their own store policy regarding credits, refunds, exchanges and lay-aways as long as those policies do not violate the KCPA. We believe this shop disclosed its policy and is not in violation of the act. The three-day cancellation period to which you refer is mandated by law only when the transaction is the subject of a door-to-door sale. A door-to-door sale occurs when the consumer's agreement or offer to purchase is made at a place other than the supplier's regular place of business. In your case, because the purchase was made at the regular place of business, the three-day cancellation period does not apply. If the store owner is unwilling to voluntarily alter his or her policy, we cannot compel them to do so. This no-refund policy is not unusual and is adopted by most bridal and formal wear shops. It is always a good practice for consumers to shop around before making the final decision and selecting that special dress. When you have reached a decision, ask the clerk about the store's refund and exchange policies before you agree to the sale. If you have doubts about your choice or the store's policy, take more time to think about it. , Although this case involves a wedding dress, the same thoughtful consideration should be given to all purchases. As the holiday season approaches, consumers will be shopping for gifts. If you have doubts about size, color or fit, or if you think a gift might have to be returned for any reason, ask the clerk about the store's return policy before you make the purchase. Both you and the store will know what to expect which should avoid future disputes. Penney sweater burns too easily By The Associated Press WASHINGTON — J.C. Penney Co. is recalling 26,240 chenille sweaters that can burn as fast as a newspaper if they catch fire. The velvety-textured sweaters failed a federal flammability regulation, prompting the voluntary recall, the U.S. Consumer Product Safety Commission said Wednesday. No injuries have been reported. Affected sweaters were sold in J.C. Penney stores as lot numbers 642-1410 and 642-1411. Lot numbers are printed on the store price tags and on customer receipts. The sweaters were also sold in the 1996 Christmas catalogue as lot number 542-0971. Check page 89, item "D," in the catalogue or refer to the shipping information. Repair kit is free for Graco playpens By The Associated Press WASHINGTON — A children's products manufacturer is offering consumers a free repair kit for playpens to prevent their mesh from unraveling. Graco Children's Products Inc. of Elverson, Pa., said Wednesday that it would offer the kits for about 133,000 traditional-style Graco playpens. The playpens were sold nationally. Consumers interested in the repair kit can call Graco at 1-800-4239078.
