A decision was rendered last week by the General Term of the Supreme Court of New York, Justice Davis delivering the opinion, which is the cause of much coninient and. interest around the City Hall among contractors und officials generally. The cause was an appeal made by the city from a judgment entered on tho report of a leieree in favor of 'William "McDonald for materials furnished for repairing cortain streets.

The leading points of the opinion are as follows: There is no question but that the materials were furnished and used; nor that recovery is for their fair value; and there seems to be ao dutibt that the plaintiff, -who delivered them, and the officers, who ordered and received and used them, acted ia good faith. To reverse the recovery, under such circumstances, seems a harsh measure of justice. But it mast not be forgotten that the officers of the corporation, and of its several departments, act under well-defined and limited authoiity, and can make no contracts binding upon the city, except within tlie authority conferred and in conformity to the mode prescribed. A relaxation of this rule would leave the city a prey to the discretion of its numerous officials, by whom unlimited liabilities might be created. All per sons dealing with such officers are bound to know the laws find -egala- tious affecting their authority, and to see to it that the power to contract not only exists, but that its exercise substantially conforms in the particular instance to the modes prescribed by statute or ordinance.
