Albert Lyon sworn--Know Mr. Smith, ttie defecdaut. In the early part of Monday evening I waa by appointment an association we were in consultation about I accompanied by two of the msnubera went toward the Strand. I then weat up to the Mercury office. I remained in the Mercury otBce for aa indefinite when Mr.

Smith came in. A very short time after lie came into the toom he addressed himself to Mr. Wilson; said that he was going to 'increase Ms dairy business and wanted to ill lie could supply him with milk. He afterwwd offered me a seat in his 'wagon. I asked him what time ha would go.

Hii said he voald havo to go to the depot after the came, as lie -was in the habit of getting his supplies. As it was after 10 o'clock, and the cars had maciBg, accepted his invitation, and renutiaed conversing with the gen- tiemen in the office. Not one word was spoken in my hearing of any plot, plan or scheme to molest anybody by those about me. 1 recognize Mr. Armstrong and Mr.

Wilson aa being ia the room, at the time. When Mr. Smith thought it time for the cars to be in, he made some Temark to that effect, and got ready to start. witness here interpolated a high compliment to Mr. We then drove up to the depot, where Mr.

Smitliiecevvel his supplies. We then drove out toward my residence. This must bive beia 1C o'clock or very near it. I had pat some questions "to Mr. Smith, which called forth the story of lus life.

Flc urnoy--The reporters will please put down tho story of his I was of coarse deeply interested in his He coiitinued to talk for nearly aa hour. This must havfl been between twelve and a quarter past twelve o'clock. I ropeat, neitber in this rkle nor in the office -vras one trord uttered in reference to this outrage. There ws some talk abcot the Coopers at the office. I went to the ofHca shortly after nine o'clock.

Mr. Smith came in 'Jrithin half hour afterward. Mr. Smith z.nd myself for the depot shortly before twelve o'clock. When 1 heard the pistol shot, shortly after arriving at homo, I looked at my watch, and it was five minutes one o'clock.

Mr. Smitli had left ine a half an hour before. A'; Ihe depot Mr. Smith, received iwo milk cans and a bag of vegetables. When he left me, he drore directly in the direction of his residence.

When I was in the Jfcr- cury office. Sir. was writing a very long article. Hy cpnveisation principally carried on with Mr. Wilson.

1 think it was twelve or a little after when left the depot. heard a pistol shot about five minutes after oae o'clock. I had sot retired when I heard the shot. 3fy wife tad heard the cry of "murder." I 'asaid the cry repeated. I only heard oms shot.

While in conveisation with Messrs. Wilson and Armstrong they slid that they entertained the same opinion of the Ckiopera as previously expressed by thum. They thought thut the Grand July should have sent the case before the Oriciiaal Court. More than a half hour passed after my parting with Mr. Snutt until I heard the pistol shot.

Mr. SmilJi had time to have gone to the residence of Cooper after levingrne bs-' came to my house ten or fifteen minutes after twelve o'clock. I liavo an alarm clock in my house. Mr. Smith sets it to awakeu lvi.ni at about eleven and three o'clock.

About two o'clock Mr. Cooper, the younger, come to the gate. There was some conversation between him and his father, who told him not 10 go in. He made some remark that ho was sick. He sung out, Osgood!" ''Oa, Mr.

Smith," "Oh, Mr. Poole," "Oil, Mr. Poole," the second time. I got out of bed, opened the window, and attked him what he wanted. Ho replied, la Mr.

Osgood in I said "So, Mr. Osgood did not livo there." lie asked me then if Mr. Smith was in? 1 said "Tea." Ho asked rus if he WES abej. I said yep. Ho asked me how long lie wag abed.

I told him "One hour." He turned around and said "Gentlemen, you hear; one-half hour." had Sly iil ife reminded me that he haJi hour. I said I didn't care, aad went to bed. I went into Mr. Smith's room after 2 o'clock to get some powders. Smith was then in bed.

Mr. Smith told me on Tuesday that ho was arrested on this Cooper scrape. I do not know any person concerned in the alleged outrage. I have for pistol shot. I am confi- deal Mr.

Smith would have gone on talk- lag fcboat past life had I not sbrupt- ly dosed tlie ooaveisation. By going immediately, Mr. Smith would have had time to join the "Darty in the lynching Cooper. I aiiglU have suspected MX. Soiith of being connected with the lynching if I had not been ia his company, --0 stated.

I might have suspected Mr. borhood. It is the first I have heard sines. been accustomed tc hearing cries of distress from Cooper's house since the 9th of July, and at first I thought it was the daughter. Mr.

Smith's employes sleep in a building on the alley back of my I told them that a message had been left for Mr. Smith. Crosg-esamined--Tho carriage stopped front of my gate about a minute; it was an open carriage. The other cur- Tiage was covered over, and looked like hospital hearse. I can not say whether there were any person's in the carriage.

I 'ihink one of the carriages drove awaj before the hollering commenced. Tho other carriage came to my house j-ist as the pistol fired. was satisfied that there was trouble over at Cooper's ihat night. I told Mr. Smith.

I thought they were taking the girl away; but whm I'heard the shot and cries I differently. I did not ask young Cooper what the matter waa. I think, the distance between, my house and Cooper's is about sisiy fset. I can't say whether Mr. Smith told mo or not that he saw four masked men sitting on the sidewalk.

I did not have tine to finish the message to Mr. Smith before the cries commenced. I think it was about half-past twelve o'clock the fuss commenced over at- Cooper's. I can't say that 1 saw any one in the open, carriage that stopped before my gate. The carriages went off in the direction cf tho graveyard.

My opportunities for soeing were aa good as my wife's. I think the open carriage was about sixty feet from me. I have not talked with any one the witnesses abont, this case since ths trial commenced. Win. O.

Davis, sworn, testified as follows--Lives in Galveston Mr. Smith, the defendant. I sleep in Mr. Poole's house in the back-yard. Monday evening 1 went-to the beach, and camu back at half-past nine o'clock.

I asked Mr. Poole where Mr. Smith was, and he said he had gono down town and would not be back until the train came in. He asked me if I would see Mr. Smith when he came back.

I told him I would. He told me that Mr. Osgood had been there to see Smith, and to tell him that his business had been all fixed up and papers signed. Mr. Smith came hoiup, I suppose, about 12 o'clock, and told mo to take out his horse and put his milk hi the ice-box.

He said he wus tired and sleepy, and wanted to go to bed. He went into tlio house, and he and Mr, PooitJ came into tlio dining-room. I saw them through the window. About ten minutes after I put away the horse and milk, I heard a ass over at Mr. Cooper's.

Mr. Smith remained in. the dairy only a short time, and then wect back into the house. I beard two pistol shots one was fired just as tho wagons were going off. I did not hear any fuss over at Cooper's before Mr.

THE WALTHAM WATCH CO.MPANT.-- The watches made by the Walthnm Company have attained a popalarit- never accorded to any other make, anc for tlie very excellent reason that all ar tides sent out from the manufactory art as near perfection as the very best material and most accurate workmftnshi cau produce. The watches made by the Waltham Companv embrace every description flize, price and design, from the chtapas to the most expensive. The cheapes watches are accurate time-keepers, ana the "works will weai as long as if i higher price was demanded. Watches are manufactured at tin Waltham Works expressly for nse engineers, conductors and travelers.

These watches are perfect in- all thei details, and can be depended on in any climate. No other watcj company a complete article, and purchasers should always ask for the NYaUbion Watch, i full supply of which are always on ham at the establishment of M. W. SHAW Corner Tremont und Market trustworthy Eggert, turned tho prow of his vessel to the westward, and ere many moments tho second moonlight bay excursion" was a reality. Now opened tlie dance, and beneath tho blue canopy of heaven fairy forms and manly figures moved hither and thither in the labarynthic-mazes of Terpsichorean pleasure.

Tho rnoou arose in all her splendor, and then the picture.was complete. Such a moving panorama of joyous fe must be seen to bo appreciated. Oft distance the dull flickering of glits told of quiet home's on shore, liad gono the pride and treasure the household to join with tiie happy rew of moonlight revelers. Tall masts nd darkened walla loomed up in the ackground, while away to the northward long lines of sand beach made a complement to the picture. Tliero was no tUouglitfor the morrow, nd so eager in tlie pursuit of pleasure were the thoughtless crew, that uo notice was taken of the speedy Might of time, pilot did not venture beyond the and so gentle was the manage ment of tlie cra.ft, that tbe passage back ind forth from the Poiat to Williams's Wharf was ma.de in sucli a manner that he excursionists were scarcely aware of He change of motion, All this while the moon contiaued to ihine brightly, and little messengers of iglit were ever and anon darting down sit upon tlie foam-capped wavelets as liey rolled from the broad expanse of ocean.

The sands of the srflooth and gently sloping beacli returned the silvery smiles of tlie bright orb of night, and the waa- deriag sea-fowl winged his weary way jomeward, dropping, in liis transit, a silent tear to think as how he was away so late while the maternal guardian of jis youthful years hardly he was out. G-entlts breeces from tlio caverns of iEolus sought to kiss tho cheek of beauty, and hovered caressingly in the locks of some natural aud much newly imported hair. Maiden breaths of air kissed maiden checks, aud then Hew on, freighted with ecstacy and musk. Stars twinkled in the f.rclies of heaven, and formed in its blue background fit to tlio language which shot forth from the laughing eyes of Southern beauty. When the NEWS reporter left, tlio dance was still going on, and with little prospect of cessation until the wee hours of day.
