Judge Trimble held that the proposed removal of Grain ns trustee of the vast Wilson estate in Mississippi county was based on the grounds that all shareholders in the R. E. L, WilsJH Trust are Indispensable pur ties to the snii. And he said that thu case "must be dismissed for want cf indispeif- sable parties." The judge said that only 35.98 per cent of the beneficial ownership was reprcsentert in the suit, leaving 04.11 per cent umeprc- sented. The presence of absent shareholders is vital to any acticn seeking to set aside the contract; muter 'which Grain operates, the court said.
