However, they said they did not know whether WCPX's parent company, Outlet Co. in Provi- dence, R.I., would appeal the ruling at the Florida Supreme Court Outlet's attorney, Jerry Scher, who is based in Washington, D.C., could not be reached for comment.

There have been cases where tax-free industrial revenue bonds have been used to purchase TV station equipment, but they have not been validated by a court. John Lord, chairman of the authority, said he was disappointed but not surprised by the ruling. "It was unique to the state of Florida," he said. "I thought there was a 50-50 chance." In his argument against the bond issue, Glicken said the TV station did not qualify as an "industrial plant," which is one use mentioned in the state's 1980 amendment to the IRB laws. Therefore, he said, the project should be tested by another criterion of the same law whether it meets a "paramount public purpose." He argued that it did not, but was primarily intended to save Outlet money.
