On the'31st of October, 1802, plaintiff' commenced; his action against the defendant, -in which he alleged that he was owner of. a lot. on East avenue extending to eaid.street, upon which was his dwelling ouse. The defendant, in an- ower. admitted the title" of the plaintiff to the premises in question, mil that it was about to construct the road through East avonne, but denied 'that it would impair the plaintiff's enjoyment.

The answer further set forth the consent of the Common ionncil of the city of Rochester, and that the road was constructed and operated in accordance with the provisions thereof. Upon this testimony the case was submitted to the courc, and on the 2d day of April, 18GS, it made its decision, which was that the railroad company derived no authority to do the acts aforesaid by the acts oi the Legislature under which it is incorporated, or from said resolutions of the Common Council of said city, without consent oi the owner of the fee, or the appraisal and payment of his damages in the mode prescribed by law, and granted a perpetual irj unction. Cotton picking is progressing finely, and the Enquirer notices tho arrival of several wagons laden with the cotton of 1lie new crop the past two days. The Enquirer fears, however, a the prairie crops, though good, will not be as large as has been expected. There is a beautiful growth of weed. but the late snilden change from wet to dry weather has cmised a forms and squares to shed.

We have already published a brief mention from a correspondent of a fearful tragedy last Saturday, at Round Top.Washington county. TheBrenham Enquirer says, from the best information it can gather, the circumstances are as follows The Germans gave a ball Walter Holt, Fatten H. Rankiu and John Rankin, sons of tho late Dr. C. Rankin, of Round Top, wore in attendance.

It seems little was teasing Holt, when Holt asked him to behave, and on a repetition of the act, Holt slapped little Johnnie. Patten Uankin interfered. Holt left the room, and Rankin, anticipating the cause placed himself: when Holt re- returned with a donblo-b shotgun he received a wound in the abdomen as he entered the gate, from a six- shooter in the hands of 1'atten Kankin. Holt was still enabled to fire on Rankin, the charge taking off one side of his head, when he fell dead. Holt was dangerously wounded, though there was still hope of his recovery when last heard from.

The freedman wisely accepted the peaceble and friendly advice thus given them, and deserted their would-be commanders.

Too much credit cannot be given to the gentlemen to whose good sense and moderation the county is indebted, for thna avoiding what appears to have been a thoroughly concocted and well managed plan for bringing on a most serious collision between the freed" men and the whites of WLarton county. 1 very much fear that as the election approaches, such attempts will be but too frequent. Will our people throughout the State have the good sense and mode 1 ration sufficient to enable them to follow this example, and achieve so noble a rictorj' as was won by tha white men of Wharton county It is to be hoped so. The Director of the London Fire Brigade has recently shown, as the result of very careful erperiments, that the ordinary test of fire engines and hose, that is the comparative distances to which water may be thrown by them, is not at all reliable or satisfactory, the real question being as to the amount of water carried by each engine to tfao most distant point. In the coarse of careful experiments mado by him on this subject, it was ascertained tbat 'though several engines might throw a stream of water to the same point, one might deliver only a fourth part of the water which left the nozzle, while another would carry one- half to the same distance. He gives, in a work recently published, elaborate instructions as to the proper curve and of the nozzle of the hose, which too technical to be reproduced here.

It may be stated, however, that it is indis- pensible that the inside of the nozzle be perfectly smooth, and that the mouth have sharp and perfect edges. A slight scratch on the inside of the though scarcely perceptible, may, it is said, materially influence the character of the stream that comes from it.
