Church Joins License Fight "How coveted is a license to operate a network-affiliated television station?" a veteran broadcast executive was once asked. "How coveted," he replied immediately, answering the question with a question, "is a Gatorade concession in hell?" Before going any farther I confess to inventing the above exchange. Nevertheless, it helps explain why the battle for control of WFTV-Channel 9 has waxed and waned, but never ceased since 1953.

BECAUSE OF the prolonged fight among five applicants before the Federal Communications Commission and in the courts, WFTV has been operated as a joint venture since April 1, 1969, pending the FCC's final decision. The applicants are Mid-Florida Television the licensee from 1958 until 1969; Central Nine Florida Heartland Television TV 9 and Comint Corp. Minority participation in station ownership has become a major issue in the license quest of Comint Corp. which has two black stockholders. Its officials have argued that they should assume control of WFTV since they represent a more varied ethnicity.

In large part, it was on the basis of this argument that a U.S. Court of Appeals set aside the FCC's 1972 reissuance of the license to Mid-Florida Television Corp. Last October, the U.S. Supreme Court rejected an appeal filed by Mid-Florida and the FCC and ordered hearings on the licensing reopened. NOW, AN activist agency long involved in license challenges announced its intention to aid the Comint cause.

The Office of Communication of the United Church of Christ and the denomination's Florida Conference on Monday petitioned the FCC for permission to appear at the license hearings. "The church wishes to present a public viewpoint, not the viewpoint of a party interested in obtaining the license, and to present its experience in knowing what minority participation might mean and the positive aspects of that," said Ralph Jennings, an associate director of the communication office reached in New York by phone. In the late 1960s, the United Church of Christ was, instrumental in the very first license challenge. The station involved was WLBT in Jackson, Miss. had done almost no local programming to serve Jackson's large black community and had censored civil rights news reported on NBC's evening -newscasts.

Taking advantage of a 1966 court decision -J which finally gave the public a voice in licensing proceedings, the church's communication office helped lead a successful fight to deny Lamar Life Insurance the WLBTlicense. Since 1969, the station has been operated by a biracial citizens group. JENNINGS SAID his office had been following the WFTV imbroglio for some time. "We feel the issue is extremely important, not only in terms of ihe case in Orlando, but nationwide," he said. "If becomes a' precedent, then whenever there's a comparative hearing for broadcast station ownership, minority participation will become an issue and a factor in favor of that applicant which has minority participation, and, hopefully, lead to greater minority participation in ownership of broadcast facilities all over the country." At present, Jennings noted, there is no minority-owned television station in the continental United States.

"The only way those patterns are going to change is if weight is given to minority participation in ownership," he said, The church's petition urges the FCC to consider whether minority participation in the station ownership will affect "increased diversity of program content; "assure a fair and equitable distribution o( broadcast facilities to black and "increase a station's ability to perform a genuine and; ongoing ascertainment of the communities' needs and, interests."
