Sunday, May 22, 2005 State St. Cloud Times 7B Judge freezes activities, assets of Burnsville online pharmacy MINNEAPOLIS (AP) - The courts took over the assets on Friday of a Burnsville-based online pharmacy that allegedly sold up to $18 million worth of drugs on the Internet. Court documents said the company mislabeled some drugs it sent to patients. U.S. District Judge Michael Davis granted prosecutors' request to shut down several online pharmacies related to Xpress Pharmacy Direct, according to court documents signed Friday. Prosecutors said in court documents the company mislabeled, mispackaged and repackaged prescription drugs. It also overcharged consumers and dispensed drugs, including narcotics and other painkillers without valid prescriptions, according to federal prosecutors. No one has been charged with a crane. Davis also froze the assets of several top ranking employees of the company, including owner and operator Christopher Smith, 25, who is listed as one of the world's 200 worst spammers, Man convicted in wife's death set to be released DULUTH (AP) - Larry Race becomes a free man Monday, 22 years after going to prison for killing his wife, Debbie, during a 14th wedding anniversary cruise on Lake Superior. One of Smith's attorneys, Bill Michael, disputed the government's allegations. "I think that what the United States Attorney's office and the Department of Justice has done is shut down a company that was on the cutting edge of using technology in the health care industry," he said. An affidavit by FBI Agent George Kyrilis said Smith's business filled thousands of orders for narcotics such as the pain reliever hydrocodone and other drugs without valid prescriptions, instead paying a New Jersey doctor $7 per prescription to sign more than 22,000 orders for drugs in one four-month period. Xpress Pharmacy relied on an established California pharmacy to fill more than 7,000 hydrocodone prescriptions signed by the doctor, the affidavit said. It is illegal for a doctor to sign a prescription without a legitimate doctor-patient relationship, the affidavit said. Assistant U.S. Attorney Greg Brooker said Xpress Pharmacy was not licensed by the state of Minnesota to sell prescriptions, and that it was not authorized by the Drug Enforcement Administration to sell controlled substances. When asked about the allegation that patients didn't get the drugs they ordered, Michael said affidavits filed by the officers who investigated the company indicate they received the medications they asked for. PAUL (AP) - The man accused of killing an undercover St. Paul police officer made his first court appearance on Friday, where a judge continued his $1 million hail Harry Jerome Evans, 32, is accused of first- and second-degree murder in the shooting death of Sgt Gerald Vick. Vick was shot outside of a St Paul bar on May 6 while working with his partner on a prostitution investigation. Ramsey County District Judge Edward S. Wilson set Evans' arraignment for May 27 and ordered that Evans' lawyers be given a transcript ofWednesdas grand jury proceedings. The grand jury indicted Evans on charges of first-degree and second-degree murder. Antonio Kelly, who was with Evans at the scene of the shooting, has been released from custody as a material witness. Kelly lias agreed to testify against Evans in exchange for his release.
