Judge delays decision on missing boy BIRMINGHAM, Ala. (AP) - A 5- year-old boy who recognized himself on a television show about missing children was briefly reunited with his mother on Friday, but a judge refused to give her permanent custody until more questions are answered. "I'm going to take Benji home where he belongs," said Jennifer Studef, 30, said of her son Benjamin Lee Studer. "I brought every paper I could find to get him." However, Family Court Judge Charles M. Nice said there was doubt about whether the boy's father, Benjamin Lester Studer, violated any law in bringing the boy from Covington, Ky., to Alabama in January 1985. The judge delayed the custody hearing until next Wednesday, pending the arrival of more court papers from Kenton County, Ky. Ralph Armstrong, attorney for the father, said Studer "had no knowledge and was never served with the divorce decree." Armstrong said the divorce was granted last June 5, five months after Benji disappeared. Jennifer Studer's attorney said the Kentucky court papers were valid and show that she has custody. . The judge allowed Jennifer Studer to spend the afternoon with Benji at a church-operated shelter where he is being cared for by state welfare workers. He cautioned both parents not to take the child from the shelter. Benjamin said it "has been a long, long time" since he had seen his mother, and had been told that she was dead.
