J. Smith vs. W. L. Qlcaauarhey--Peti- tion for mandamus: Smith owned a confederate certificate and caused it to be llled upon two tracts of land lying in Newton county and caused the lands to be surveyed end the livid notes returned.

OHO survi-y was for 1251 acres and the other for 32SO. They were not contiguous, but each embraced all the vacant land in tiie tract. The tract first mentioned was located for Smith and the second for the school fund. After the decision in Von Rosenberg vs. Cuellar, 80 249.

Smith caused each of the two tracts to be subdivided Into two surveys equal In quantity, and returned the new field notes to the land office. The new surveys on the first tract were numbered 1 and 2, and the two on the other 3 and 4. Surveys 1 and 3 purported to be for petitioner and 2 4 for the state. It may be conceded that Smith was not entitled -to locate the entire certificate upon 'the two disconnected tracts and 'to designate which should be for his own benefit. It does not follow that he would not have -the right to cause each par- eel to be resurveyed into two equal tracts in order to comply with the intent of the statute.

Whether he had this right or not depends upon the question whether the original locoitions were void or merely erroneous. Smith was entitled to locate the certlfica-te in part upon the one tract and In part upon the other. He had the right to appropriate all the land in. the two surveys, and the fact that he has'nils- taken his right and has claimed and deslfj- na'ted one survey for himself and -the other for the state should not render void the location. It has been the uniform practice to correct errors In surveys, and no good reason is seen why the rule should not apply In -the present case.

Smith asks for patents to the two tracts, 1 and and this ralfws the question who has right of selection? The confederate certificate act does not expressly provide, but properly construed it. requires the commissioner to act In analogy 'to -the practice under other statutes and to select for the school fund and patent the others to plaintiff.
