THE SCOTT CASE UP, Tennant's Testimony as fo Money Placed in the Defendant's Hands. Question of Partnership Between Scott and Tennant--The Bank Enterprise at Wharton--The Garnishment. The case of the stafte of Texn.i vs. L. Scott, for embezzlement, came up In -the criminal cVlstrlct court yesterday morning tiefore Judge Cavln.

Tn anticipation of It Uc-Ing called, the court room was tilled. A large number of -witnesses 'had been called, a of whom are ou-talde residents of the state. The -Indictment that on August 1892, the defendant was "consignee, bailee and agent of .1. H. Tennant, and waa then and there consignee and bailee of certain money then and -there paid to Mm, the sAld J.

L. Scott, to -wl-t, $765, Vlilcli said money -was then and there the property of the said J. H. Tennant, and had then and there oom-e into possession and was under the care of tho said. J.

L. Scott by virtue of sold conslgti'ment, l)aillment and agency nnd employment 'aforesaid. And the sa.id L. Scott did tihen and there fraudulently, without the consent of the said J. H.

Tennant, his principal and employer, embezzle, misapply omd convert to -his own use the said money, against the peace and dignity of the state." The state -woa represented by District At- toruey J. K. P. Gillasple. The defendant handled his own case, being assisted, by At'torney Tt.

S. Rowland. The panel of jurymen having been summoned, Mr. Scott quest-Ioned them as 'to the existence of any bios or prejudice against the defendant on their part, and Mr. John A.

Caplen was excused Tor prejudice. The jurymen -were also questioned as'to whether they 'had -talked Tvitih any of the witnesses or had formed un opinion in the case. The following jurymen were selected and sworn: W. S. Beadles, D.

W. Copes and James Moore, .1. Tennnnt called for the prosecution, and, answering quest-Ions from Mr. Gillasplc, testified: "I know the defendant. L.

Scott. 1 in-trusted liim with $7GG in money, he acting as my agent." Mr. Scott objected on the grounds that no money had been intrusted to Mm of that amount. Objection overruled, money was in the form of a draft and -wris subsequently deposited 'by Mr. Scott dn the Galveston national bank.

Objected to to Mr. Scott as hearsay evidence, and objection sustained. A letter by Mr. Scott to Mr. Tennant was "here 'Introduced by the district attorney to prove the deposit from the following extract.

The letter is dated September 3, 1892: "i 'have deposited check in. the Galveston national r.nJ no tilled Fry tha-t saild bank subject to my draft upon said completion of bis contract with you."
