Gaming Tax Case Convicted A federal district court jury here late yesterday convicted Herman Doc McQueen, Apopka Negro, of failing to register as gambler and pay federal gambling taxes. The gambling tax case was first ever to be heard in Orlando. The gambling tax law, which became effective Nov.

1, 1951, was designed purposely to expose gamblers and to make gambling less profitable. In another such case yesterday, Ira James West of Winter Park, also a Negro, pleaded nollo contendere and bis case was turned over to the probation officer, W. Martin Noland, for pre-sentencing investigation. Nollo contendere means the defendant will not contest the case. The indictment against McQueen specifically charged that he did not register and pay the federal gam bling tax during December, 1951 and January, 1952.

The government charged that McQueen sold bolita numbers during that period. McQueen was arrested by Chief of Police William J. Dunaway of Apopka last Jan. 11 on a gambling charge and later turned over to federal authorities when he allegedly had not paid for a federal gam bling tax stamp. A number of bolita books and lists of customers which McQueen had in his pockets at the time of the arrest were brought into evi dence.

Walter McDanlets, Jacksonville who was in charge of registration of all wagering stamp in Florida at the time of the alleged offense told the court that McQueen had not paid a tax stamp for Decern ber, 1951 or January, 1952, despite the fict that he was selling bolita tickets. McDaniels said that since Apri McQueen has registered and paid the tax, in fact has paid for gam bling tax stamps through to June 30, 1953. On the applications for the tax stamps, which cost $50 a year, McQueen stated that he was working as an agent for Condor Merritt, Altamonte Springs Negro. The tax evasion charge carries a maximum penalty of one year in prison or $10,000 fine, or both. It requires that gamblers pay to the federal government 10 pet.
