OCTOBER 5, 1996 CONSUMER THE SALINA JOURNAL T CONSUMER CORNER Federal law offers protection from debt collectors CARLA STOVALL Kansas Attorney General Dear Attorney General Stovall: About five years ago, my son (who was 2 years old at the time) became ill and had to be hospitalized for almost three months. Both my wife and I took him to the hospital to be admitted, but I signed all the paperwork agreeing to pay whatever our insurance (which was through my employer) wouldn't cover. Both of us had to take some time off from work because of Nick's illness. To make a long story short, my wife and I eventually divorced and I lost my job. Consequently, I fell behind on paying some of my bills. Now, almost five years later, I'm still getting back on my feet. I got a new job and am slowly catching up my bill payments. Just when things started looking up for me. I began getting telephone calls from a very rude and cranky woman who said she'd been hired to collect money owed on our son's hospital bills. This same woman has been calling me at work and yelling at me. I'm really getting tired of it and so is my boss. Attorney General Stovall, the last thing I need is to lose my job. Is there anything I can do to stop this harassment? Dear Kansas Consumer: The Kansas Consumer Protection Act is intended to protect consumers against deceptive and unconscionable business practices. Although there is nothing within the Kansas Consumer Protection Act that specifically addresses debt collection, the Consumer Protection Division of my office often assists consumers in mediating disputes with bill collectors and/or coming to a mutually acceptable solution whereby the consumer may get his or her bills paid. The Fair Debt Collection Practices Act is a federal law and is enforced by the Federal Trade Commission. A consumer also has the right to sue a collector within one year from the date the law was violated. The federal act allows consumers to request that bill collectors not contact them at their place of employment, if the collector knows the employer disapproves. The bill collector should be advised in writing that you do not wish to be contacted at your place of employment. You may also ask the collector not to contact you at home. We suggest that you send the letters via certified mail, return receipt requested, so that you'll have proof that you sent them. The Fair Debt Collection Practices Act also sets forth the ways in which a collector may contact consumers (in person, by mail, telephone, telegram, or fax), and when (between 8:00 a.m. and 9:00 p.m., unless the consumer agrees to a deviation). If you have further questions about the Fair Debt Collection Practices Act, you may contact the regional FTC office by writing to: 1405 Curtis Street, Suite No. 2900, Denver, CO 80202-2393 or calling 303-844-2271; oi- by contacting my Consumer Protection Division or a private attorney. • BRIEFLY Baby monitors are subject of recall WASHINGTON — Nearly 1 million baby monitors are being recalled by Gerry Baby Products Co., after reports that improperly connected wires could cause monitors to overheat and possibly catch fire. In announcing the recall of Model 602 Deluxe Baby Monitors, the Consumer Product Safety Commission said it knows of two fires, including one that killed a person and injured another. The company also had a report of a fire that did not cause injury. The commission also has had 13 reports of the monitor becoming warm to the touch, including burning one person's skin. The company says that only one of the 16 reports has been conclusively linked to the Model 602 monitor. The two-piece, gray and blue monitors under recall resemble walkie-talkies. The recall in- v volves monitors with date codes ' from June 1988 (8806) to May 1990 (9005). Consumers with affected monitors should call Gerry at 800-6726289 for information on how to return the recalled monitors for free replacements. Recall of blood drug is expanded : WASHINGTON — A Pennsylvania company that recently recalled human albumin linked to blood poisoning announced Thursday it was taking 100,000 more vials of the product off hospital shelves. Sold under the brand name Al- buminar, the product made from plasma is used to treat low blood pressure in burn and shock victims and dialysis patients. . Manufacturer Centeon, King of Prussia, Pa., recalled one lot of Albuminar in late September because of evidence it was tainted with the bacterium Enterobacter cloacae. Two patients, one in • Kansas and one in Wisconsin, '. survived serious blood infections after receiving albumin from that lot. Since then, the Food and Drug Administration has investigated two additional cases of blood poisoning, one that does appear , linked to the recalled Albuminar and another more questionable. The recalled lots are: P18607, L8212, M60902, MS412, L58211, M61403, M63204, M54912 and P61805. The earlier recalled lot is P61205. Mechanics may get to disconnect air bags : WASHINGTON — The govern. ment's traffic safety agency is considering allowing auto mechanics to disconnect air bags. • Instances of small children be! ing killed by the powerful bags have raised safety concerns recently. Short adults, who tend to sit closer to the front of the car, also are thought to be at risk. In addition, there are worries ', that the loud bang that occurs ; when an air bag inflates could endanger the hearing of certain people. . Various people have written to ; the National Highway Traffic i Safety Administration and re: ceived permission to have air ; bags disconnected on a case-by- icase basis, spokesman Tim Kurd 'said. ; Under the law, individuals are • permitted to disconnect air bags ', on their own cars but auto me; chanics are banned from doing •so. Kurd said the agency is work; ing on a policy that would establish overall standards for allow• ing bags to be disconnected. Meanwhile, passenger-side air bag on-off switches are being allowed in some vehicles, such as ; pickup trucks, where children ; have to ride in the front because • there is no back seat. ''. The National Transportation ; Safety Board has called for a • study of whether lives could be saved by developing air bags that would be triggered at higher crash speeds and that would inflate with less power.
