Charged Texan Insulted Negro Captain; Wouldn't Shake Hands FRANKFURT, Germany (UP) -First Lt. William C. Morton of San Antonio, has been charged with disrespect and in- lult for refusing to shake hands with his Negro superior officer, his lawyer said today. Morton, 33, resigned his commission rather than face court martial on the charges but has since withdrawn the resignation and asked to be tried. His attorney, Franklin Potter of Los Angeles said Morton broke no law or regulation by refusing shake hands with Capt.

Carl O'Kelley, of Tucson, Ariz. The charges were filed aftc Morton refused to take the hand offered by O'Kelley in the pres ence of several enlistd men las Dec. 27. Witnesses said Morton stood a attention when O'Kelley, newly arrived to his Medical Corps unil entered the orderly room. When the greatest buy in FI HI Magnavox 95 rabbed 3 Speakers Auxiliary Connection Diamond Stylus ROSELLA'S 1712 Washington Telephone 2-8191 O'Kellejr offered his hand, they Mid, Morton did not take it even though the captain held it out for fully a minute.

"May.I?" O'Kelley finally asked Morton: "May shake your hand?" and then took him into another room to talk it over when Morton declined. Morton then was reported to have told O'Kelley he had been taught not to shake hands with Negroes. Morton offered his resignation after learning that charges were eing filed and that he could receive up to five years imprisonment if convicted of disrespect to his superior. Later, he changed his mind and sked to have the resignation 'oiHed because it was made un- ler "extreme mental duress and anxiety." The trial will not be held until the question of the resignation is leared up. Potter said "If imprisonment dishonorable discharge is a penalty for not shaking hands, it time that our military law be hanged." "There are thousands of gen- lemen from the South and all ther regions who know you don't ave to be a hand-shaker to be a entleman," the attorney said.
