Himmei, admitted to probate in the Orphans' Court yesterday. The balance of the estate is given to Mr, nimmel's widow, Mrs.

Hannah Himmei. Mr. lllmmel's sons, Solomon and Leon W. Himmei, were constituted executors without bond. The executors are directed In the will to abide by and respect articles of copartnership entered Into by Mr.

MRS. KATE D. WINDER'S WILL Leaves Estate To Members Of Her Family. The will of Mrs. Kate D.

Winder, filed for probate in the Orphans' Court yester day, bequeaths $300 for the erection of a monument over her grave and the grave of her husband, the late Dr. Richard Bayly inder, in Loudon Fark Cemetery. Other speciflc bequests in the will are as foliows: Dr. R. Bayly Winder, stepson of Mrs.

Bayly, and his wife, $400; Mrs. Harry S. Miller, stepdaughter, and her husband, foOO, and Kate Winder Dorsey, Lucy Dor sey and Henrietta Sprigg Keen, nieces, $100 each. The residue of the estate is given by the will to Mrs. Winder's nephew, Frank Dorsey.

Alexander Hardcastle is named in the will as executor. The will is dated July 27 last. A codicil, dated September 7 last, re duces the legacy to Dr. R. Bayly Winder and his wife from $400 to $200.

The codi ell also gives $100 additional each to Kate Winder Dorsey and Lucy Dorsey, besides a breastpin to each. The pictures In Mrs Winder's home, 716 Park avenue, are given to Dr. R. J. Frank Turner Plans Apart ment House Setting- Limestone Iligrh In The Air. The Colonial Trust Company, whose office has been at 13 West Saratoga street since the fire, announces by advertisement in The Scn that a one-story structure for the company's use will be erected on the Sara toga and Clay street lots recently acquired by it. On Saratoga street the lot is known as 3-11, and the Clay street lot is 12. They adjoin in the rear.

The Saratoga street lot has a frontage of 6G feet and the Clay street one is about 20 feet. The Saratoga street property adjoins the lot at the south west corner of Charles street which is owned by the Metropolitan Savings Bank. Th.is lot Is also to be Improved with a hand some home for the savings bank. The erection of the two structures will add not a little to that section of the city. Mr.

J. Frank Turner, North avenue and Charles street, said yesterday that he will improve the lot which he owns at the south east corner of North avenue and Lovegrove alley with a four-story apartment house, Mr. Turner said the work of excavation for the structure will begin at once and that John E. Marshall Son will likely get the contract. The lot has a frontage of 73 feet on North avenue and extends about 193 feet along Lovegrove alley.

Nearly the entire lot will be covered bv the nroDOsed struc ture, and the first floor will be used for stores. Several inquiries for property In the vi cinity of Charles street and North avenue have been made by real estate brokers, and an offer of $40,000 for that at the southeast corner of those thoroughfares has been made. This lot Is only partly improved. It is understood the offer was made for Mr. Turner, and that he would have erected an apartment house at that corner if he had secured the property.

The trustees of the estate which owns the corner are holding the property at about $45,000. Work of setting the limestone on the Bal timore street front of the Baltimore and Ohio Railroad Company's office building at the northwest corner of Baltimore and Charles streets was begun yesterday at the seventh floor, and attracted a large crowd of spectators. To begin the laying of brick at the sixth or seventh story is not a new sight in Baltimore, but the setting of stone work at the seventh story is a novel scene. The whole of both fronts of the Baltimore and Ohio Building will be of granite and limestone. Granite will be used to the fourth story.

The United States Dental Association has leased the second floor of the Pendleton Building, southwest corner of Charles and Fayette streets, through John A. Barker Son. Child's lunch room will occupy the first floor. DEAF-MUTE LOSES HIS CASE Judsre Dobler Decides In Favor Of United Railways. The trial in the suit of Charles T.

Get tier, a deaf-mute, against the United Rail ways and Electric Company afforded a novel and interesting spectacle to specta tors in the City Court yesterday. Mr. Get-tier being unable to speak or hear, It was necessary for him to testify in the sign language. For this purpose two interpreters were employed. One, Mrs.

William C. Mc Card, wife of a colored lawyer, can both speak and hear, besides being an expert in the sign language. The other was Rev. E. Moylan, a deaf-mute.

Mr. Gettier was struck by a car on the evening of Sunday, October 11, 1903, near Gwynn Oak junction, and he claimed 000 damages for the Injuries he received When he was called to testify Mrs. McCard was sworn by Bailiff Crane to truly inter pret, and then she, in the sign language. administered the oath to Mr. Gettier.

Some of the words were voiced by Mrs. McCard, besides being spelled with her fingers. At times Mr. Gettier did not understand what she said, and then Rev. Mr.

Moylan assisted in the work. Mr. Gettier testified through Mrs. McCard that he is 42 years old that he lives at 1028 McCulloh street and has no occupation. He was returning from a visit to his brother near Gwynn Ook Park when he was injured.

In a graphic manner Mr. Get tier showed how he was injured, using in his illustration a plat affixed to a black board. The first and second fingers of Mr. Gettier traveled over the representation of a railway track on the plat and Mrs. Mc Card explained that he was showing how he walked up the track from his brother's house.

"He stopped, looked for a car," Mrs. McCard went on, interpreting Mr. Get- tier's motions. "His trousers caught in a switch. He reached down to release them and the car struck him." Mr.

Gettier's brother, John F. Gettier, testified that since the accident the injured man has been quite dull. At the of the testimony for Mr. Gettier a verdict for the railway company was rendered by the jury under the instructions of Judge Dobler. The Judge said that the evidence had not shown that the accident was caused by any negligence or want of care on the part of the company.

Messrs. William Colton and William W. Varney appeared for Mr. Gettier and Mr. Arthur D.

Foster for the company. HE READ IT IN THE SUN Mr. (1. M. Boarman, Of Chester, Testifies In Polk Will Case.

Mr. George M. Boarman, of Chester, who has been a reader of The Sux 42 years, was among the witnesses who testified yes terday in Part 2 of the Superior Court in the trial of the suit to break the second will of Mrs. Mary Polk. He was formerly a clerk in the City Ho tel, Westminster, which belonged to Mrs.

Polk's husband, the late Col. Robert M. Polk. After moving from the State Mr, Boarman continued a reader of The Sun, and, seeing in it accounts of the present trial, he volunteered to testify in favor of Mrs. Eldridge Packham, niece of Mrs.

Polk, and her children, who are trying to break the will. Mr. Boarman said that while he was a clerk at the City Hotel Colonel and Mrs. Packham, who spend their summers there, evidenced the greatest affection for Mrs. rackham.

Mr. Louis Packham, brother of Mrs. Pack- ham's husband, also testified for her. He said that he had volunteered as a witness in the trial of the suit to break Mrs. Polk's third will and that he and his brother then became reconciled after an estrangement of years.

The trial over the third will resulted in the will being broken. Messrs. Ernest Foster and J. George Koehlein, both of whom had been employed by Mrs. Polk to do work for her, testified yesterday in support of the will.

Mr. Foster said that Mrs. Polk reasoned well and talked intelligently and was very careful" about spending money. She never showed any signs of unsoundness of mind, in Mr. Foster's opinion.

Mr. Koehlein declared that Mrs. Polk un derstood what 6he was doing. After the proceedings to have her declared a lunatic, Mr. Koehlein also testified, Mrs.

George S. Mann, son of County Com-t missioner Mann, has undergone another operation on nccount of the fracture of one of his legs near the hip joint on June 20. This operation was performed at the City Hospital by Professor Chambers, who was obliged to unite the bone by the use of fine silver wire. The operation was skillfully and successfully done, and hopes are entertained for Mr. Mann's rapid recovery.
