In addition to the powers conferred by Seotion 630 of this Article, any holder of a license to sell intoxicating liquors, at retaa, by the drirJc or otherwise, may assign, hypothecate or pledge said license to any person, firm, association or corporation as security for the repayment of any debt or the performance of any obligation, and the instrument so assigning, hypothecating or pledging said license shall, upon the application of the person, firm association or corporation to whom the same shall have been made, be recorded bv said Board as provided in Section 669 of this Article and whenever it shall be made to appear to said Board, upon petition duly veritied by affidavit, that default has occurred in any of the conditions set forth in said Instrument, hypothecation or pledge, and the licensee refuses to deliver the license to the party thereby entitled to same, the said Board shall have power after such hearing as it may deem advisable to revoke the original license and issue a duplicate license in lieu thereof, and upon so receiving said duplicate license the said assignee or pledgee shall have all the rights and privileges conferred upon holders of licenses by the provisions of this Article; provided, however, that nothing in this section contained shall prevent any licensee who shall have assigned, hypothecated or piedged a license under the provisions of thia Section from prosecuting the business for which said license was granted until the same shall have been revoked by said Board under the provisions of this Section, and provided further, that nothing in this Article contained shall prevent the issuing of duplicate licenses under the provisions of this feection to any person or corporation whatsoever: provided, also, that no license thus assigned, hypothecated or pledged, nor any duplicate license thus issued shall be used or disposed of by any transferee or assignee except for rehypothe-cation. cancellation or redemption without complying with provisions of Article 690 of this Act. 690B. Any holder of a license to sell intoxicating liquors at retail, by the dri -ik or otherwise, against whom no indictment ia pending for the violation of the Liquor laws during the year for which said license was granted, and who shall not have been convicted for any such violation of said Liquor laws during the said-year for which the said license waa issued, who ahall cease to traffic in liquors during the term for which such license waa issued, and who shall surrender such license to the Board of Liquor License Commissioners, and who shall at the same time file with- the said Board of Liq-our License Commissioners a petition in such general form as the Board may prescribe, duly sworn to before a notary public or justice of the peace, asking to have the license marked "canceled," shall be entitled to have the amount paid for such license refunded pro rat for the unexpired portion of the term for which such license was granted, less ten dollars; provided, that no refund shall be allowed or paid npon the surrender of such license unless the same shall have at leaft one full calendar month jet to run. And upon the surrender of said license and the filing of said petition the said Board of Liauor License Commissioner shall thereupon compute the amount of refund then due on said license for the unexpired term thereof.

less ten dollars, and shall execute duplicate vouchers therefor, showing the name of the person to whom the original license was issued, the number of said license the date when issued, the amount paid therefor, and the date when surrendered for cancellation, together with the amount of refund due thereon at such date as computed by them, the name of the person entitled to receive the refund and a warrant to the Clerk of the Court of Common Pleas directing him to pay said refund, as set forth in said vouchers, to the person so entitled, and one of said vouchers the said Board shall deliver to the person entitled thereto, together with said warrant on the Clerk of said Court of Common Pleas, and the other of Raid vouchers it shall immediately transmit, together with the surrendered license, to the said Clerk of the said Court of Common Pleas, and the said Clerk of the said Court of Common Pleas, upon the presentation and surrender to him of the said voucher and warrant given to the said petitioner, shall pay to him or his per-flonal representatives or assign the amount called for by such vouchers and warrant out of such funds from the proceeds of liquor licenses as may be in his hands, as Clerk of said Court, at the time, or if insufficient funds are in his hands at the time of presentation of such warrant, then out of the first funds from the proceeds of liquor licenses that come into his hands, and in his next quarterly statement and accounting to the State of Maryland he shall be entitled to full credit for the amount thus paid, such warrants to be paid in the order in which they are issued. There shall be a board to be known as the Board of Trustees of the Teachers" Retirement Fund of Baltimore City, to be composed of seven persons, who shall serve without compensation tor their duties aa members of said board. The said Board of Trustees shall be composed of the City Comptroller, the Superintendent of Public Instruction, two members of the Board of School Com missioners, to oe elected by said Board of School L.ommissioners annuallv In the mmith at nnmhr beginning in the year 1909, and the members ao elect ea snail cecouie members of said Board of Trustees on the 15th day of January next foUowing the date of their election, provided that as soon as practicable after the tkhshup nf tlii A-.

th Board of School Commissioners shall elect two of its memoers to serve as members of the said Board of Trustees until the member Rlected in nr lim ber, 19u9, shall become members of said Board of trustees, ana three members of the teaching force of Baltimore city who shall be elected in the following manner: On the third Monday of November in each year, beginning in the vear 1909. the members of the teaching force of Baltimore city shall deposit with the said Board of Trustees a sealed ballot containing the names of three teachers representing his or her choice for membership of the said Board of Trustees. The Board of Trustees shall examine said ballots and give to each teacher receiving a vote credit therefor, and the three teachers receiving the highest number of rotes under the said ballots shall become members of the said Board of Trustees on the 15th dav of January next following the date of their election. In case of a raeancv in said Board of Trustees by reason of death, resignation, or through any other cause, of a member of the teaching force the Board of Trustees shall elect a member rorce as a member of said Board of Trustees for the une-rnirrl form r.t tv, who has ceased to be such. In case of a vacancy on said Board of Trustees by reason of death, resignation or through any other cause, of a member of the Board of School Commissioners, the said Board of School Commiasioners Bhall forthwith elect one or memoers as a member of said Board of Trustees fpr the unexpired terra of the person who has ceased to be such. 102C. A majority of said Board of Trustees shall constitute a quorum for the transacfirm .11 ness. Said Board of Trustees shall elect from its members a President, and Bhall annoint a tary and a Treasurer, both of which offices may be neia ny tne same person, ana the said Board of Trustees shall have power to appoint such, other employes as it may from time to time deem necessary to carry out the purposes of thi Act, and uie aaiu cuiuu snail pay to tne secretary, and employes such salaries as mav flrpd by the Board, provided that the salaries paid to the Secretary. Treasurer and such other emrJoves and the number of such other employes shall be suojectea to tne approval or the Board of Estimates.

It shall be the duty of the Secretary to keep a true and accurate account of the proceedings of said Board of Trustees when acting upon matters relating to said Teachers" Retirement Fund, and he shall perform such other duties aa the Board of Trustees Bhall direct. The Secretary of the Board of School Commission ers of said city shall act as Assistant Secretary of tne uoara cr witn sucn additional compensation therefor as may be fixed and paid by the Board of Trustees, with the approval cf the Board of Estimates, and it shall be his duty to keep a true and correct statement of the account of each member with the Teachers' Retirement Fund and to render to the Board of Trustees a monthly account of his doings. The Treasurer of said Board of Trustees shall receive, hold and keep account of all moneys belonging to the Teachers' Retirement Fund; he shall have the custody of all notes, bonds and other securities belonging to said Teachers Retirement Fund, and shall collect the principal and. interest of the same, but before assuming to act as such Treasurer he shall furnish bond in such penalty and with such surety or sureties as the Board of Trustees may require, conditioned for the faithful performance of the duties imposed upon him by this- Act, or that may be assigned to him by tho Board or Trustees, and for the faithful accounting of all moneys and securities, including both principal and interest, which may come into his hands, and which belong to tha Teachers" Retirement Fund. Such Treasurer, upon the expiration of his term of office, shall account to said Board for ail moneys notes, bonds and other securities coming into his hands, and for the interest, income, profits rentals and proceeds of and from the same, and he shall turn over to his successor all moneys, notes, bonds and other securities belonging to said fund.

The Secretary, Assistant Secretary and Treasurer ahallmakea fuU, true and accurate account of their offices whenever required so to do by the Board of Trustees. 102.Every teacher who ia such at the time cf the passage of this Act shall, as soon as practicable thereafter, notify the said Board of Trustees, in writing, whether he or she desires to accept the advantages of this Act or any amendments thereto, and every such, acceptance when given shall be irrevocable, and no such teacher who does not so accept, shall be eligible for election to said Board of Trustees, nor shall he or she have the right to vote for members thereof. And every such teacher who shall fail so to accept before January 1, 1903, shall not be entitled to any benefits or advantages under this Act until he or she shall have first paid into the Teachers Retirement Fund an amount equal to the assessments he or she would have paid Into said found had such acceptance been given on December 31, 1908, together with 20 perceutuin of such amount, KCF. Hereafter the Board of School Commissioners shall require all applicants for apjoint-ment as teachers to agree, as a condition of appointment, to accept aud abide by the provisions of this Act or any amen thereto, and to pay the assessments provided for herein, or that mav be provided fr hereafter. 102G.

All money, property of any kind or securities that may crime into the hand of the said Board of Trustees, under the provisions of this Act cr anv amendments thereto. ahaU be known as the Teachers' Retirement Fund, and the said Board of Trustees is hereby clothed with full and complete power and exclusive control over said fund, and is hereby empowered to have, demand, receive, hold, invest and reinvest the same the promotion of the purposes cf eaid fund, which shall consist of the following: First: Assessments upon the salary of every teacher who shall notify the Board of of his cr her acceptance of the provisions cf this Act and amendments thereto tinder Section 1ME, and assessments upon the salary each and every teacher who mav be appointed after the date of the passage cf this Act, as follows: One rerceitinn per annum (but not more than $11.40) upon the salary of every teacher who shall not have been engBged in excess of years in the public schools of Baltimore city one and one-half percentvtm per annr.m. Second: Sums received from the Mayor and City Council, as follows: In case the Board of Trus tees shall deem it erpeqient to have an additional ttm to defray its expenses, to pay the salaries rrovided rcr herein or to aaa to the Teachers Retirement Fund, the said Board of Trustees shall each year in due time prepare a full and detailed statement of the assets cf ss id Teachers' Retirement Fund and the additional sum which is required to defray said expanses, to pay said salaries or to add to the Teachers' Retirement Fund, and snd th same to the Board of Esti mates, as other estimates are sent to it in con-neetlrn with the annual ordinance of estimate, and the Board of Estimates is hereby empowered in its dirretion to inwrt such sn appropriation in said ordinance for said purposes as it mav deem proper, and when snid appropriation has been re-mrwl the same shall be mid ovr to the Board of Tni'-i. and the unexpended M-ano remaining at the end of escli fiscal year ahall added i the permanent fund, in accordance with Section 107NI of this Act, Third: All money, property of any kind or securities that may come into the hands of said Board of Trustee for the purposes of said Teachers' Retirement Fund by gift, grant, devise, bequest or Ot rrwi3e. 112H. If the Board of Trustees, after such proceedings are had. sua-1 find the said teacher to be incaparatated from performing regular duty, the Board of School Commissioners may retire such, teacher from regular duty and such teacher, if so retvrd, thall be entitled to a salarv in the same manner axia amount as if he or she had been retired upon his her own application under this section.

102J. Unless teachers who may be retired under the two preceding sections shall have paia into said Teachers' Retirement Fund by way cl sessment or otherwise an amount equal at lease to that which he or she shall be entitled to receive as a salary for the first year of retirewent. the said Board of Trustees shall deduct one-filth of the derieiency thereof from the sinonct of eaia salary for each of the first fiv years that tus same may be pavable. Every teacher retired under the provisions this Act shall continue as an employe of tiia Mayor and City Council, but shall be cororn-sated from the Teachers' Retirement Fund provided for in this Act- and it shall the duty of anv teacher so retired to render, without extra, compensation, such teaching sc-rrices and at S'lctj times as the Board of School tVunmissioners shall direct, provided the Board of School Commissioners shall not direct any such retired teacher to perform anv teaching service, except, such ttij Board of Trustees may certify to the Board of School Commission's to be within the reasons a phvsicsl power of such retired teacher, and provided further, that no such retired teacher shall be required to render teaching service for a longer periVl than 15 iavs in anv school fear.

102M. The Board of Trustees shall establish permanent fund, to the credit of which shall bo put and deposited all gifts, grants, devises and bequests, all other receipts for the first two years during which this Act shall have become operative, except so much of such receipts as the Board of Trustees mav require during said two years to defrav its expenses and the unexpended balance remaining at the end of each fiscal year thereafter. And no part thereof shall be expended, except the interest and income thereof and therefrom; provided, however, that one-half of the amount added to such permanent fund during any vear mav be used, if necessary, during the year Immediately following. 102N. This Act shall not affect in any -way th power of the Board of School Commissioners tv remove teachers from service under the laws now in force.

102O. Upon tho retirement of any teacher under Seotion 102H the person so shall be entitled to receive a salary for lifa out of trie Teachers' Retiremsmt Fund equal to one-half of his or her average annual salary for the five years immediately preceding retirement, but no salary of anv teacher 6hall be less than $360. nor greater than $000 per annum, and the Board of Trustees, subject to such reasonable rules or regulations as the Board mav adopt, shall pay the salaries to the persons entitled thereto under thia section and Sections 102 and 1021. 102P. Any teacher who shall cease to be sucn before receiving anv benefits from said Teachers Retirement Fund shall be entitled to the return of one-half of the amount, without interest, which shall have been paid into said Teachers' Retirement Fund bv such teacher; provided, however, should such teacher thereafter again teach in th public schools of eaid city such teacher shall repay to said Teaehers' Retirement Fund tha amount so returned to such teachers, 'within one year from the date of his or her return to servi.s in the schools, and upon such repayment being made he or she shall be entitled to credit for the length of time of the former service.

And should any teacher die before receiving any of the benefits by this Act provided, the Board of Trustees shall pay to such, teacher's estate one-half the amount, without interest, which shall have been paid into said Teachers' Retirement Fund by said 1C2Q No salary of any kind whatsoever provided for in this Act shall be payable or paid during the first two veara during which said Act ah ail become operative; provided, further, should any contributors to said Teachers' Retirement Fund make application for retirement under the provisions of this Act during said two years, his or her name shall be placed upon a waiting list, and he or she shall be retired in the order of his or her application when said two years shall have expired but no teacher shall be retired by the Board "of School Commissioners under this Act until after the expiration of said two years. 102R The said Teachers' Retirement Fund and all salaries granted and payable out of the same shall be and are exempt from seizure or levy under attachment, execution, supplemental procesf rnwai and such salaries or any payment of the same shall not be subiect to sale, assignment or transfer by any benefir-iarv, and any such sale, assignment or transfer of tha same shall be absolutely void- 102S.
