Dead firefighter absolved of alleged arson involvement TAMPA (AP) A Tampa firefighter fired in 1977 for his alleged involvement in an arson-for-profit ring has been reinstated even though he died seven months ago. John Nicholas Lostracco's conviction on charges of arson, conspiracy and mail fraud was overturned by the 5th U.S.

Circuit Court of Appeals last June. On Monday, the Tampa Civil Service Commission ruled that the city could not prove he violated a civil service law on "moral turpitude." a Lostracco died of heart complications eight days before the appellate court's ruling. The issue before the board Monday was the back pay and pension benefits sought by Lostracco's widow, Angela. Graham said Congress, at the behest of the INS, had passed a law eliminating the 30-year-old reporting requirement. It required aliens to fill out a card and notify the INS of their whereabouts every January. Graham said the INS sought the change in the law "because we can get the information from other sources in our records." She noted aliens are still required to notify the INS whenever they change their address. The annual reporting system did not work particularly well, she said. "We weren't able to police it.

The number of people reporting did not reflect the total tracco had been on the force as a driver-engineer for more than 18 years when he was fired. In 1977, he was charged with 22 other: people in an arson-for-profit network that became known as "'The Enterprise." It was broken up after a 17-month FBI probe of prominent businessmen, reputed mobsters and a former Tampa fire marshal. The investigation focused on allegations that local business owners defrauded insurance companies by over-estimating the value of properties, burning them and collecting high claims. Lostracco was charged with meeting admitted arsonist Willie Noriega and co-defendant Paul Guarino to plot the torching of a house. Noriega pleaded guilty in exchange for a light sentence and claimed Lostracco paid him to set Lostracco had denied the charges, saying he was trying to sell the property to his brother-in-law.
