Fort Myers News-Press, Saturday July 17, 1976 Dateline: Florida Parental Consent Still Valid MIAMI (AP) Although the U.S. Supreme Court has ruled that minor women may have an abortion without the consent of their parents, officials say parental consent still is needed for all other elective surgery. Atty. Gen. Robert Shevin says the July 1 ruling by the court is "limited strictly to abortions and only because of the right of privacy issue you can't say that in terms of an operation or any other surgical procedure." Therefore, minors seeking elective surgery to correct disfigurements or for sterilization must have the consent of their parents.

D. Ralph Millard, chief of the Division of Plastic Surgery of the University of Miami School of Medicine, said plastic surgery is performed without parental consent only in cases of emergency. Dr. Wiliam Little, chairman of the Department of Obstetrics and Gynecology at the same school, said his department performs between 600 and 1,200 sterilizations a year, but only one or two women under 21 had undergone elective sterilization. "We have not sterilized anybody less than 18 who has been single, unless it was therapy for a cancer or something.

else resulting in sterilization," he said. Even ear piercing might require parental consent, officials say. Although it does not appear to be surgery, the piercing of ears does involve making a tiny cut in the skin. IRS Agent Indicted After Probe PITTSBURGH (UPI) A former Internal Revenue Service agent was indicted Friday by a federal grand jury for accepting money from Gulf Oil Corp. to vacation in Pompano Beach, Fla.

while he was supervisan audit of the company's income tax returns. U.S. Attorney Blair A. Griffith called the indictment a "the first concrete result" of special investigation of gratuities authorities contend were accepted by IRS agents. The investigation was conducted by inspectors of the IRS Inspection Service's internal security division in conjunction with the U.S.

attorney's office for the Western District of Pennsylvania. The indictment charged that Gulf paid a total of $356.80 for the agent, Cyril J. Niederberger, 69, Pittsburgh, his wife, son and daughter to stay at the Beachcomer Lodge and Villas resort between July 11-17, 1971. Gulf is accused of mailing a $50 deposit to the hotel in advance. At the time, Niederberger was the case auditor of a "routine audit" of Gulf's 1962, 1963 and 1964 federal income taxes.

He had several agents working under him, according to the IRS. Griffith said the five-year statute of limitations on the Niederberger case would have expired Saturday. He would not say whether Niederberger would be indicted on other charges later. 'Crazy Joe' Sentenced To Die SANFORD (AP) A former Orlando-area motorcycle gang leader was sentenced to death Friday in the 1973 mutilation killing of an Orlando hospital clerk. Joseph "Crazy Joe" Spaziano, 29, was convicted in a jury trial last January, but sentencing had been postponed four times.

He was sentenced for the 1973 killing of Laura Lynn Harberts, 18, whose body was found near Altamonte Springs in Central Florida. Circuit Judge Robert McGregor passed sentence with the traditional words, "Mr. Spaziano, may God have mercy on your soul." Spaziano turned to the courtroom full of people, and smiled, patting the death-head tatto on his arm. The trial jury had recommended a life sentence, but McGregor said Friday that he thought the jury would have recommended death if it had known more about Spaziano. Spaziano is appealing a sentence of life plus five years in the 1975 rape of an Orlando girl whose eyes were slashed by her attacker.

Children See Mother Stabbed JACKSONVILLE (UPI) A 44- year-old man stabbed his wife to death in the presence of his children Friday after he found her at another man's house before dawn, police said. Homicide Detective F. M. Williams said Lawrence Harris came home from work early Friday and then left, but returned and could not find his wife, Elizabeth. Harris took his two children, a 10-year-old girl and a 7-year-old boy, with him as he went looking for his wife.

Police said he found her at the home of Oliver Edmond Jr. The couple had an argument in the front yard of Edmond's home and Harris suddenly stabbed her while the children watched, police said. Police said both children said they saw their father kill their mother with a knife about five inches long. Police said he apparently threw the knife away and so far they have not been able to find it. Harris was arrested and charged with murder.

Runaways Raped By 2 Men JACKSONVILLE (UPI) Two runaway girls from Maryland, hitchhiking south, were picked up and raped by a man driving a tractor trailer rig full of chickens and another man who joined them later, police reported Friday. The girls, a 16-year-old from Poplar Bluff and a 17-year-old from Fisk, were picked up early Thursday on Interstate 75 and driven to the truck driver's home in Jacksonville, police said. They were joined by another man who followed the first man and the two girls in another car down a dirt road, where each man raped one of the girls, according to police. The girls were then taken to a downtown bus depot where the men promised to buy them tickets for Daytona Beach. The girls said they wanted to return to Maryland and asked the men for money.

The men refused and left the depot and the runaways called police. They were being housed in the city's juvenile shelter before being sent back to their homes, police said. Gambling Jury Indicts 25 ORLANDO (UPI) The statewide grand jury investigating gambling and its link to organized crime returned 25 indictments Friday against persons in Orange and Semipole Counties. The indictments were sealed but special prosecutor Eugene Whitworth, the Alachua County state attorney, said they all were felony counts and were about equally divided between the two Central Florida counties. He said the indictments bring to "close to 500" the number of indictments returned during the grand jury's 16-month investigation.

He did not have figures on how many convictions there have been. The panel will complete its investigation in September after meeting in Duval and Dade counties. It will present a final report of gambling activities in Florida to the Florida Supreme Court in early October. Included in the grand jury's probe in Orlando since Wednesday was a lottery operation in the area. Whitworth said the grand jury is "pointing out to citizens that there is a with gambling and organized crime.

Because grand jury sessions are secret, he said, it might be beneficial to have a public Crime Commission with subpoena power, similar to a body in New Jersey. Dr. FAHMY M. RIZK, M.D. announces the opening of his new oftice for General Practice.

Paul Gallico, Author And Sports Writer, Dies MONTE CARLO, Monaco (AP) Paul Gallico, whose Mitty-esque exploits in sports captivated a generation and whose novel "'The Poseidon Adventure" became a hit movie, has died at 78. Gallico, who started as a sports writer and branched into writing novels and short stories, was halfway through a sequel to "'The Poseidon Adventure" when he died in Monte Carlo on Thursday, 10 days before his 79th birthday. On the staff of the New York Daily News during the 1930s, Gallico reportedly was one of the highest paid sportswriters in a city where Damon Runyon, Grantland Rice and Westbrook Pegler reigned. He started his career in journalism in 1922 as a movie reviewer for the News and joined the sports department soon after. He was named sports editor in 1924.

In his early years as a sportswriter, Gallico began a series challenges to professional sportsmen, similar to the more recent exploits of writer George PAUL GALLICO in 1971 photo Plimpton and the daydreams of James Thurber's fictional Walter Mitty. He is survived by his widow, Baroness Virginia von Falz-Fein. They were married in 1963. He also leaves two sons, William and Robert, and a step-daughter, Lud- "Seventeen, and still in Sunday School." "And I wouldn't miss it for anything.
