The whole force or marines and seamen was drawn from the Brooklyn Jsavy -Yard, under authority conferred upon General Barlow by a special commission issued by the President a few days since. In about ten minutes the "forlorn hope" were on their reel again, and at the worn of command, "Scatter!" they betook themselves to the fields and concealing themselves behind stumps and fences slowly surrounded the building and crept up closer. Moreover, he had no proofs whatever of armament or o. anything Jlse of which to accuse them. Yesterday Judge Bosworth heard evidence as to le copdition of the following superannuated patrolmen whom it is sought to Judge, Sixth precinct; appointed Sep. ember 15,1859.

It appears since the 1st of Juiy, 858, he has been off duty for 382 days. Br. Gibson testified mat he had attended him all along, and in bis judgment he is not fit for rull tmty; could not arrest prisoners, but might penorm. court duty or sanitary duty. He is about sixty years or age.

Jonathan Olsborne, Thirteenth precinct: appointed April born April 5, 1805; off duty through sickness for fourteen days aud a hair since July, 1863. Dr. Blevm testified that in Jlarcli. 1S66, lie received injuries from which he still sunerrai. lie is detailed at the Jackson ferry.

David Costello, Thirteenth precinct, born February, lS2r, was appointed February isoi, and since July 1,1868, has lost eleven days. Dr. Bievin testified that he has had pulmonary consumption for four or live years; in? opinion was that he is not fit Tor duty. Coslello stated that he was injured the July not by being knocked down and trampled upon by the crowd. Dr.jacDouneli considered his condition incurable, aud he is now in an asylum. Under the law they can be retired by a majority vote otlhe Board aud cannot receive more than saoo per year. It is likely that, with one or two exceptious the above parties will be retired, as the medical testimony shows they are unfit, for duty. The rurther hearing is set for to-morrow. M.
