Section 3.02 Acting County Manager The Commission, in consultation with the County Manager, shall designate an acting County Manager to exercise the powers and perform the duties of County Manager during his temporary absence or disability. D u r i n g such absence or disability, t h e C o m m i s s i o n m a y r e v o k e such designation at any time and appoint another officer of the county to serve until the Manager shall return or his disability shall cease. Section 3.03 Duties of County Manager (1) The County Manager shall be the chief administrative officer of the county; he shall be responsible to the Commission for the administration of all county affairs placed in his charge by this Charter, law, ordinance, or resolution. (2) The Manager shall: (a) Carry out policies established by the Commission. (b) Direct, supervise, and administer all departments, agencies and offices of the county except as otherwise provided by this Charter. (c) Report to the Commission and recommend measures on the affairs and financial condition of the county as the Commission may require. (d) Execute bonds, notes, contracts, and written obligations of the county, subject to the approval of the Commission. (e).Prepare and present the budget to the Commission for its approval; and execute the budget adopted by the Commission. (f) Appoint, suspend and remove all employees of the county; except that approval by a majority of the Commission shall be required in the case of all appointed department heads. (g) Submit suggested revisions in the Administrative Code and the Personnel System. (h) Attend Commission meetings, and may take part in the discussion, but he may not vote. ARTICLE IV SHERIFF Section 4.01 Election, Term, Compensation, Vacancy Removal (1) There shall be nominated and elected at large in a partisan election, a Sheriff who shall serve a term of four (4) years. (2) The compensation for the Sheriff shall be set by ordinance. (3) Vacancies and removal shall be determined in the same manner as prescribed for Commissioners in Section 2.02 of this Charter. The Sheriff shall forfeit his office under the same conditions as prescribed for Commissioners in Section 2.02 of this Charter. (4) In the event of temporary absence of disability, the Under Sheriff, shall serve as acting sheriff. In the performance of these duties, the Sheriff's Department shall be considered an independent department. Section 4.03 Administrative Accountability For administrative purposes, the Sheriff shall be a department head and responsible to the Commission as provided in the Administrative Code and the Personnel System. ARTICLE V COUNTY ATTORNEY Section 5.01 Election, Term, Compensation, Vacancy and Removal (1) There shall be nominated and elected at large in a partisan election, a County Attorney who shall serve a term of four (4) years and who shall possess the qualifications prescribed by state law. (2) The compensation for the County Attorney shall be set by ordinance. (3) Vacancies and removal shall be determined in the same manner as prescribed for Commissioners in Section 2.02 of this Charter. The County Attorney shall forfeit his office under the same conditions as prescribed for Commissioners in Section 2.02 of this Charter. (4) In the event of temporary absence or disability, a Deputy County Attorney, previously designated as his substitute by the County Attorney, with the approval and consent of the Commission, shall serve as acting County Attorney, Section 5.02 Powers and Duties The County Attorney shall perform all duties charged to him by law, this Charter, ordinance and resolution. In the performance of these duties, the County Attorney's Department shall be considered an independent department. Section 5.03 Administrative Accountability For administrative purposes, the County Attorney shall be a department head and responsible to the Commission as provided in the Administrative Code and the Personnel System. ARTICLE VI ADMINISTRATION Section 6.01 General The activities under the direction and supervision of the County Manager shall be distributed among such departments, agencies and offices as are established by this Charter or that may be established in the Administrative Code in order to execute and enforce policies as determined by the Commission and to carry out obligations imposed on the county by state law. Section 6.02 The Administrative Code The Commission shall adopt, and may amend an Administrative Code. The Administrative Code shall include: 1. The departmental organization of the government, the nature and scope of each department, and all required rules end procedures for department operation. 2. Comprehensive budget procedures for the government. 3. Procedures regarding boards, commissions, advisors, studies, and any other government activities. Section 6.03 The Personnel System The Commission shall adopt, and may amend, a Personnel System. The County Personnel System shall include a salary schedule, provisions for vacations, sick leaves, insurance and other benefits for all employees in accordance with provisions of the Charter. Procedures shall be provided for employees to have an opportunity to be heard upon their request pending discharge, suspension, or any designated disciplinary action. Such other procedures as are necessary for an equitable personnel system shall be included. ARTICLE VII NOMINATIONS AND ELECTIONS Section 7.01 Elected County Offices The procedure for the nomination and election of all elected county offices shall be as prescribed by state law for partisan elections. Section 7.02 Districts For purposes of representation on the County Commission, Flathead County shall be divided into three (3) districts. Boundaries of commission districts may be changed in accordance with this Charter. Section 7,03 Reapporlionment' of Commission Districts (1) Within six (6) months after an official United States Census becomes available which establishes that the population of any district differs in number from the population of any other district by more than fifteen per cent (15%), the Commission shall modify the boundaries of districts so that such difference is elminated. ARTICLE VIII POPULAR CONTROLS Section 8.01 Initiative, Referendum and Recall The people of Flathead County may exercise initiative, referendum, and recall as provided by law. Section 8.02 Charter Amendment The people of Flathead County may amend this Charter according to provisions of law.
