To Question Lilienthal Senators Seek Definition of Rights Regarding New Atomic Commission By JACK BELL WASHINGTON, Jan. 28 (AP)--The senate atomic committee sought today to define explicitly the right of congress and the armed services to know what is going on inside the new atomic control commission. Chairman Hickenlooper (R) of Iowa told a reporter he expects this definition to be spelled out in no uncertain before the committee gets through questioning David E. Lilienthal. Lilienthal named as chairman of the commission, is serving under a recess appointment.

Similarly, Senator Knowland (R) of California said in a separate interview he believes that "now is the time to find out whether congress and the armed forces are going to know at all times what the commission is considering or whether they are going to be told afterward that something is an accomplished fact." Recalled to the stand today Lilienthal faced not only questioning on this point but a barrage attack from his long-time political enemy, Senator McKellar (D) of Tennessee. McKellar is not a committee member but is commuting between the atomic hearing and inquiries into the nomination of Gordon R. Clapp to be a TVA director, which he also opposes. McKellar told Lilienthal, former TVA chairman, at yesterday's atomic committee session that he was certain Lilienthal knows "nothing in the world about splitting the atom." The hearing was recessed at that point until today. But committee members indicated they are much more interested in the question of how often Lilienthal and his four colleagues on the commission intend to consult military leaders and congress.

Some of them expressed surprise at the new atomic chairman's testimony that the commission had not consulted with Maj. Gen. Leslie R. Groves since it took over operation of the power and bomb producing setup at the stroke of the new year. Groves was head of the A- bomb project while it was under military control.

Senator Millikin (R) of Colorado said this seemed "incredible" to him, but Lilienthal replied that the commission had been very busy setting up its organization. It had consulted frequently with Groves before December 31, he added. Senator Vandenberg (R) of Michigan said he wants it definitely established that there will be no "closed door anywhere in the commission, either to the military liaison committee or to congress." Lilienthal agreed that ought to know at all times what is going on, but he said in response to a question that he didn't think the liaison group would be invited into committee meetings. Later he told the committee he was willing to take this matter under consideration. 'One-Man Army' Wermuth May Re-enlist in Army DENVER.

Jan. 28 (P)-Maj. Arthur J. Wermuth, Michigan's "one-! man army of Bataan," has offered to re-enlist in the army, but it is up to the war department to decide whether his rank may be as high as master sergeant. Yesterday the Denver recruiting office told the 32-year-old veteran, formerly of Traverse City, that the highest grade it could give him was staff sergeant, since more than 20 days elapsed between the end of his terminal leave and his filing of enlistment papers.

Wermuth offered to re-enlist as a master sergeant, and army officers said the question had been put to the war department. To be eligible for 20-year-retirement benefits, the former Bataan fighter needs 12 more years of army service.
