Some members say that the unfortunate younsr man should not be allowed to be present at his own funerjU, but opinion seems to be divided on this score, some holding one way and some a.nother, so the young man will have to decide for himself whether he wishes to see his own remains interred beneath the earth. The constitution of the Galveston Skull nes swlet provides that membership shall be limited to fifty-two younir men. The club started out with thirteen- charter members. At their annuaJ banciuet thirteen, more were Initiated, maklnt? a total of twenty-six.

At the last regular meeting thcr? were thirteen more applications ror mf.mberh'ip, which were accepted making a total of thirty-nine, so that the club can take in only thirteen more men. It has been decided to take in these thirteen other members over the casket at the funeral and make them pall barera of the body. This is rather a. repulsive job end it Is -whether the secretory will -be overrun with candidates- desiring-to become members. In order to become a lull-neagod advocate of the Skull and Bones cause one has to go through many disagreeable experiences, but doubtless the most disagreeable of all will be the one that QcvoH-ei, upon the young man who will be chosen to bury the corpse.

A Corporation Organized to Manufacture Montgomery County's Product. Conroe, Montgomery June corporation ims been organized with capital stock of $100,000, to be known as the Texas tobacco growing and manufacturing company. This deal was consummated by the means of a visit of some northern capitalist to Conroe and Mr. C. H.

Williams, and has been in contemplation for some time. It Is an incorporation with $100,000 capital for the manufacture of Montgomery county tobacco Into cigars, smoking- and chewing tobacco. The incorporators are C. Mai-den of Winthrop, Prank C. Howe of Boston.

Geo. E. Mudg-ett of Conroe, J. S. Daugherty of Houston, and Chas, H.

Williams of Conroe, Tex. Flans have been made and approved for the erection of a two- story warehouse 100x40 feet to begin with, and will be located at Williams' ranclf, one and three-quarters miles just north of town. This place has been selected on account of Its elftvatlon. The corporation has purchased 200 acres of land of Mr. C.

H. Williams and has the" assurance of plenty more Und adjoining Mr. Williams' tract. It will be strictly a Texas and Montgomery county institution, and besides manufacturing will enter largely in the growing of tobacco also, as It expects to put in fifty acres of tobacco the comlpg year. The gentlemen who have gone into this enterprise 'have plenty of money to back them.

They expect to have a large corps of cigar makers from the north and if the weather admits they will be ready this year's- crop. A TEXA'RKANA TRAGEDY. Melvin Anderson Shoots and Kills Edward Baker--Cause of the Difficulty. Texarkana, June is the scene of another killing. Last night Melvin A-nderson shot and Edward Baker.

The tragedy took place in the Home on Broad street. The difficulty started last-Monday; wTien is a deputy constable, made an unwilling witness of Baker against a grocery store for Sunday violation in selling cigarettes. The men quarreled about the matter, but no blows were passed, and they were gether yesterday, seemingly good friendti; At night Baker got drunk, and seeing Anderson leaning on the bar at the Home saloon, walked up 'to him and dealt him a blow in the face, and at -the same time drawing his pistol. Anderson went after his gun, and both men fired at almost the same time. Anderson shot three times, killing Baker instantly.

Anderson was not hit, and as soon as he saw the result, went to 'the city marshal and gave -himself up, and Is under guard now waiting 1 an Investigation. Baker was-only 20 years old, and was the support of a widowed mother. He carried a policy in the Provident union for $1000. TERRIBLE ACCIDENT. June Glove Tea't, and, two- children -while crossing the Iron bridge across Lampasas river, aibout two mi-lea below here, were struck by the east bound freight train and Mrs.

Teat and -I'ittle boy knocked off and are supposed to be injured. The little girl escaped getting out on one of the brace timbers. A TRAIN OF THOUGHT. Thinking- people must io i about. (From a standpoint of travel, the new fast 'train, the Santa Fe Limited, is offered.

This new train made its first trip between Galveston and St. Louis on June 9. It Is scheduled, to majte the run in thirty- six hours, and up to the present time has not failed -to arrive at St. Louis promptly on time. i Bear in i a this Is the only vesti- buled train, running solid without change between Texas and St.

Louis, carrying Pullman's finest buffet sleepers and Santa reclining- chair cars; seats free. Austin June L. Thulemeyer vs. State--Appeal from Travis: Forgery. A continuance wus on ucvount of the absence of one Cook, whose resMe4.ce defendant stated he did no: know, uiu that he usi-d due diligence to tind -where he could bo fonnd; that he had employed Hetev-iive to looute. him, and letter was attached showing that Cook was located at Iiuredo.

This letter seems to have been written hy Knahan In San Antonio to fendant, also in San Antonio. It was pro posnl to prove by Cook that he had giv defendant power of attorney to collect warrant on the state treasury. which the subject of tlie forgery. The fort-try consisted Indorsing on the back of a treasury war rant for direct tux the names "U'm per Wm. M. cook. jr. and th proofs show that tlvis indorsement made In Bexar county by appellant for purpose of negotiating the warrant to bank In Sa.n Antonio.

The bank cashc the warmn.t. paying Hie money to appel ant. nnd forwarded it to Austin for ro lection. So far as appellant was concerne. this was a complete transaction.

It was longer his property, bin of the bank In ftt Antonio. The statute provides that th offense of forgery may be prosecuted any county where the instrument wa forged or where ttoe same was used passed. The case of Bishop vs. State (3 34) is pertinent to the issue presenter and is quoted at length 1n the opinion. I this case the transaction constituting th forgery, Including fhe absolute transfer the instrument, was consummated in Bexa and appellant had no further control ove or interest in the warrant.

He had doubt anticipated t'hat 'the bank woul collect the money from the treasurv a Austin, but to him t'hat was a matter indifference. Our statute has reference some act done by the alleged forger in th county In which he is to be prose cuted. Whether he does this by himself by an agent IB Immaterial; but where has panted wilth the instrument and ha no property In or 1 control over Vhe same can not be prosecuted therefor in som other county, in which some other partv has subsequently passed it. Wiley Williams vs. State--Appeal fror San Saba: Violating local option law: the commissioners' court, upon a petition of fifty voters, order an election for loca option in a part of the county embracing two justices' precincts, calling the same a subdivision and describing the territor" bi metes and bounds? The question is" an swered in the affirmative. Afflrnieil. Opin ion by Henderson, J. Qi'Uao Hall-Appeal from ooa: Hall was arrested on two warrants one for carrying a pistol and for assaul to rape.

Both cases were pending before a justice. In the assault case he was held to bail in the sum of $250. In the pisto case he was fined--the fine and costs amounting to 8 S7 an(ii ne was comn tea to jail until the same was paid On Peb ruary 5 thereafter he made oath that he was too poor to pay.lt. Qn March 1 re later offered bail in the assault case, -which the sheriff refused to take, unless he would pay the line and costs in the pistol case Held, that the sheriff, should have taken the bail. On acceptance of bail -it became the duty ot the county judge to hire ou the convict.

Failing to do this, defendan was entitled to $3 per day since March 1 when he tendered bail. That would' dis charge the line nnd costs, and so relator was entitled to discharge from custody on account of the pistol case. The grand jury failed to find a bill for felony, but for ag sravated assault. That case Is not here for consideration. Applicant discharged Opinion by Henderson, J.

B. F. Clements vs. State--Appeal from Lamar: Incest. Defendant put in issue the legitimacy of his daughter and asks a reversal on the ground that the evidence sustained the issue.

The question waa fairly submitted to the jury and their finding Is supported. Evidence of cruel treatment of the daughter, It appearing that this was for the purpose of forcing her to submit to his will, was admissible Af firmed. Opinion by J. John Rope'vs. State--Appeal from Bee Assault.

The injured person was namet S. Garzla and the proof Is that his name was S. Garcia. Held, Idem sonans. It was also proved that the name Garcia is generally called by Americans Garza.
