Borden said that the city's code only addresses gas-powered vehicles, which his bikes are not, he said. "We're 100 percent electric, 100 percent green," he said. The Segways also may be exempt from Delray's law regarding mopeds and scooters. A Florida statute dealing with motorized vehicles classifies Segways as "Electric Personal Assistive Mobility Devices." As to how the two businesses are still allowed to operate? "Everyone knows we're working with the land development regulations to accommodate these businesses," Harden said.

The Electric Experience on East Atlantic Avenue, east of the Intra-coastal Waterway Bridge. Borden said he applied for a license under the proper procedures, and when he tried to get approval for his sign he found out his license was revoked. "We were working to have a grand opening but didn't want to do it until we get the proper license," Borden said. Initially, City Commissioner Fred Fetzer asked staff to consider changes to the zoning rules that prohibit moped and scooter rentals in the downtown area during a City Commission meeting Dec 7. Since then, however, Fetzer said he thought it would be bet running tours every day," said Segway Tours of Delray's owner Buck Ward.

"That's with the city's permission. (But) we have not gotten formal approval yet." The city's code does not allow motorized vehicle rental businesses to open in the central business district or the city's downtown but it's unclear how these businesses managed to open. Ward, along with the Greater Delray Beach Chamber of Commerce, held a grand opening in November, only to find out a few days later that the rental of motorized-vehicles was not allowed in the Pineapple Grove area where he opened his shop. Similarly, Jason Borden opened By MARIA HERRERA Sun Sentinel DELRAY BEACH City officials are considering changes to zoning rules to accommodate two new businesses that opened in the city's downtown without proper licensing. Segway Tours of Delray, which offers tours on the two-wheeled motorized vehicles, and The Electric Experiences, an electric bicycle rental, have been operating without proper business licenses for at least two months.

According to the city, The Electric Experience has a pending business license, while Segway Tours of Delray doesn't come up in the city's database.
