I told Senator O'Brien about the war hla brother used me, and be aaid he was very-Sorry." Great laughter.) Assistant District AMornev Rasseli asked what re-, lation this evidence had to tbe death of McEeuna. Ex-Rebel ellow explained that aa counsel for the prisuoers he had, in view of the Police Court proceedings, prepared evidence to show that on the fatal morning men in the interest of O'Brien were going through the di tract beating and atsaulung those opposed to them. i IHatncl Attorney fiussell said tint it bad got pothiag to do vltu tba dsatb of McKeoua, waa irreaevsnt evidence, and asked that it be stricken out.

Coroner Woltmaa reioctantly ruled it so. The next witness was a genuine surprise to the prisoners, Ex-Rebel Fellows, Corroer Woltnisn, and alobn Kellv. It--waa a little boy named Eujeue Healy, resfding at N331 East Thirty-third street. During the examination of this boy. Coroner Woltmaa did all in his power to confuse tbe witness, although it was perfectly evident to all dm in teres ted persons that tne boy not only meant to tell tbe whole truth, but Was telling it aa beat be knew how.

The boy described hpw O'Brien and Croker met and abused each other; that Croker hit O'Brien, and the latter hit back that Croker and a tall man, whom people around said waa Hickey, drew revolvers that McKenna stepped forward, and that Croker and Hickey, leveling, toeir revolvers at bim tired, on which McKenna fell on the atreet in tbe manner described by previous witnesses; that Senator 0 Brien ran behuid a veoder'a wagon to escsoe from Hickey, who fired two shots at bim. He, the wit- neas, turned McKenna over on his back, aud helped to cany him to the drug store. Senator O'Brien said to bim, "honny. did you see anything of and witness answered, "Yea, when Senator Brieu aaid. You ouht to go and see the Police." Witness went to the ststion-bouse, and tbe Sergeant -took his name and address.

He waa eubpOBnaed by Capt. Allaire. Coroner Woltman cross-exam I tied the boy fur over twenty minutes, trying to contuse bim. 1'lie boy at once identified Croker, whom, he aaid, be had seen -before; but said he could ardly recoguixe Hickey, whom be had never seen before, ss men look so diiterent on toe street and in a room. Hs did not identify Hickey until tbe two Hickeys stood up, when he identified George Hickey aa the man.

As the bov left the witness-stand, District Attorney Kusselt took his name and address, and cautioned b'iiu against apeak ing to any one about the case. I bo mas Murphy, of No. 581 Second avenue, saw O'Bnea and Croker clinch, aad at once ran into a neighboring hallway. While there heard several abuts. On coming out aaw McKenna lying i set-down on tbe street, and aaw Sheridan near the rail-way track, revolver in hand, firing on McKenna.

Coroner Woltman then aaid that as tbe inquest would be very protracted, if Would be begun at 10 o'clock A. M. each day, and continued until -4 o'clock P. a recess cf tjf hour fur dinner being taken at clock. Hs would at this stage adjourn the inquest until 10 o'clock to-day.

District Attorney Busaeil aaid Mr. Coroner Before the adjournment ia carried into effect, I would, with the greatest respect, offer a suggestion. 1 bave understood that the parties bo stand here in the attitude of prisoners bave been since this occurrence st large on baiL Tbe tight or. justice of your taking bail under auch circumstances 1 de not propose either here or In any other place to cavil at or criticise. To-day, however, tbqee persons are distinctly chsrged with homicide, oa the evidence in sworn testimony ol'eeveial witnesses with the high crime of homicide, and I earnestly hope tbey will be delivered into the custody of the proper othceaa, and ia custody until the termination of this inquisition.

This is the usual coarse, it has been done in toe cases of other prisoners, not so prominentas these, and 1 think there should be but one law fur the rich and peor, high andJuw, and not for one above the I make this suggestion in the utmost kindness and ceurtes.vvand with the earnest hope that it will meet your approval." -Taia motion ol Mr. Russell took John Kelly, Ex-Rebel 1'ellows. and Cruker completely by surprise. However, Croker looked at Fellows, sal Fellows looked st John Kelly, aud Honest" John caught the eye of Coroner Woltman. There was magiu ia tbe Coroner Woltman leaned back in his cbatr, and with an assumption of dignity and an equally discreditable effort to speak grammatical Juigdsb, aaid that -with all' deference to tbe District Attorney, be did not see any reason tor committing Croker, tbe Hickrs, and Sbendan.

Tne case, to bis Dilad, waa in tne same as it waa on the day the homicide. The evidence given under oath was, in bis opinion, contradictory, and he did not see any necessity lor adopting the course eng. gested by tbe District Attorney. The inquest was then adjourned to to-day. 1 Aa Assistant District Attorney Russell left' be said that be had an idea bia suggestion would not be adopted, but he desired to place himself upon tne record, and let the public indge of the mstter.

The afoornment had hardly been earned into effect when Uthcer Webber, of the Tombs Squad, made bis sppearance with a warrant issued by Justice Morgan for the arrest of John Sheridan, charging bim with assault with intent to The complaint waa made by x-Seoator O'Brien, who swore that Sheridan fired a revolver at bim. Honest" John Keily waa sitting near Sheiidan when the officer en-tereo, and asked the officer to bring Sheridan before Coroner Woltman-; This the officer acceded to, aod Woltman came in in a few minucea. Honest" John aaid This officer baa a warrant for Sheridan's arrest for assault and battery. by Judge Morgan. Aa I understand the law, Sheridan ia now virtually in your custody, under yeursubncfiaa, aad I do not think you bave any rignt to surrender him." Coroner Woltmaa waa not alow to take Honest" John's hint, and Said Givs Juige Morgan my compliments, and tell him Sheridan lain my custody, waiting to testily under my sub pons, and that be ran have bim when I get through wth bim." All that Officer Weboer could do, under the circumstances, waa to aay, I will tell udge Morgan." and walk out of the room with bis unserved warrant in bis pocket.
