If anything, the loss of season ticket sales was due to the loss of Vachon and would not likely be made up by McCourt's addition to the team, De-Mascio said. "IF 9A is necesary to protect gate receipts, why then is it necessary to be applied to all players?" DeMascio asked. Instead, the rule discourages NHL member clubs from seeking to sign free agents, depresses player salaries and robs them of the opportunity to put their talents on the free market, DeMascio said.

"We conclude that the NHL and member clubs knew that this rule would discourage other member clubs from seeking free agents' services. It denies a player a chance to sign in a free and open market," he added. MOVING MCCOURT from a team where he is a rising star to one where there are other players of his caliber would do the center "irreparable harm," DeMascio concluded. "Like all other sports figures, this player has the inalienable right to pursue super stardom." In his rookie season, McCourt had 33 goals and 39 assists to lead the club in scoring. IN ADDITION, DeMascio concluded that the Kings had alternatives to demanding such compensation from Detroit.

"We agree that the compensation can be obtained just as easily through wisely selected draft choices," he said.
