BENHAM MURDER TRIAL Defease Attempts tm Shaw That Alleged Vletfsa Was Attained ta the lae of Marphlae.

BAT A VIA, X. July 15. The taking of evidence for the defense in the Benham: wife murder trial was continued here today. Mr. Benham, the mother of the defendant.

In testifying regarding her daughter-in-law, "Florence "was always hateful about taking her medicine. She said she wanted only Ir. Townsend's medicine because that would make her have a good long sleep. I have seen her get up from the bed when she was in this drowsy condition and get a powder from a small box." Other evidence on the same line was given in an attempt to show that the woman alleged to have been murdered was addicted to the use of morphine. William Hmith testified to May Wlard's visit to Benham's house in October with her brother.

He said none of the party was drunk except Coachman Klein. At no time' during the vir.it were Miss Wiard, and Benham alone together. On cross-examination he said Mm Benham was in South Byron on the date of Miss Wiard's Fred Andrews, the liveryman, who took Benham and a girl to Akron, was called to the stand and Miss Wiard's picture was handed him. Is that the picture of the woman who waa with Benham at asked Air. Mackey.

No, It is not." he answered. The proprietors of the two hotels at Akron were recalled and both swore that May Wiard was not the girl Benham had with him at their places. Charles M. (Jibson, an Oak Orchard hotel keeper, testified that the relations between Mr. and Mrs.

Benham appeared to be friendly. After several other witnesses had given testimony as to the friendly relations existing between Benham and his wife, Will-lam C. Watson was called to the stand. Mr. Watson is the lawyer who was retained by Benham and afterward ostensibly threw up the case.

The witness testified that while he was acting as counsel for Benham he had talked with Frank Klein regarding the case, and Klein had said to him that he knew nothing unfavorable to the prisoner. Mrs. Prentis had. also made a similar remark to him. Benham's counsel, Mr.

Mackey, then announced that he had no further evidence to offer excepting that of the medical experts, and as he wished to consult with these ex- Ferts as to hypothetical questions, he asked or an adjournment until morning, which was granted. persons to pose -as special excise agents or exployes of the Excise Department, with a view of blackmailing liquor dealers. Few complaints against these blackmailers, however, have been made to the Excise Department, and therefore no oases of this kind have' been taken to the courts. State Excise Commissioner Lyman is in receipt of a communication to-day to the effect that three persons giving their mimes as Sam Simpson of New York, John Wells of Brooklyn, and Thomas Green of New-York have been arrested on complaint of Frank Becker of long Island City for having bunkoed him out of S13 by representing themselves as special excise agents and selling him tickets to an alleged picnic for the benefit of special agants.
