The facts are these The plaintiff, a hfassachusetu or pr ration, brought their action to recover possessioa of tbs acboonsr Ann S. titer, which was held by the defendant Wlllett, as Sheriff, by virtue of a levy under an execution agaiaat one Edsar Spragne, whom It is coiicadedjprlor to the 9th of March. The plaintiffs It appears made out their title from Sprague aa foiloaa: Sprague being Insolvent, as alleged, conveyed this vessel to Cotlyer A lmtn on the Vth of March, 1857, tn trost to pay his certain liahJlitie to the plaintiff. Unler that -astigsBiCDt tie assignees made a verbal aale the schooner on the 9th of March, 1857, while the veaael waa at New-Orleans, in April, ttitf, a bill of sale was executed by the assignees, not to tbe plalntiSs, but to Nahum Stetson, Secretary and Treasurer to the Company. The bill of sale contained a bluk enrollment, but aubsequently anew enrollment aa made out to Stetson, as sole owner, by which the vesrel appear to have been enrolled at New-Orleans, In January, 1667.
