I CHICAGO DAILY TRIBUNE Thursday, Oct. 30, 1952 ARMY COMRADE TELLS OF EX-GI BOWING TO JAPS Treason Trial Hears of to Enemy New York, Oct. 29 -A former army comrade today backed the government's claim and said former Sgt. John D. Provoo met the Japanese conquerors of Corregidor with a low, oriental bow of welcome.

Provoo made a deep bow as the Japanese soldiers entered the United, States. Capt. headquarters Richard Sak- tunakida testified at Provoo's treason trial. "He spoke in Japanese, saying he was a Buddhist priest, that he spoke the Japanese language and would like to be of service to them." Sakakida-a purple heart veteran with a chestful of ribbonssolemnly demonstrated to a jury of seven women and five men how the how went. With arms at his sides, he bent low the waist in oriental fashion.

Faces Death Penalty Provoo, 35, but A disciple of ancient, stoic horns Buddhist religion, faces a possible death penalty if convicted on 12 counts. is of turning renegade in 1912 to serve the Japanese captors of the Philippines, broadcasting propaganda for them and pointing out Arnerican fellow captives to them for brutalities. The defense admitted Provoo broadcast propaganda, but said he! did so only on pain of death by the Japanese. His lawyers called Provoo a patriotic man. The government opened its case today with records to show Provoo left a bank clerk's job in Francisco in 1940 to go to Japan, intending to spend six years there training for the Buddhist priest rood.

The Pacific cut that short and he returned and joined the army in 1911. Born In Hawall Capt. Sakakida, one of the gOVernment's first witnesses, was born i in Hawaii of Japanese parents. He described the Japanese entry into Malinta tunnel, which housed American headquarters on Corregidor and a hospital. Sakakida said the Jap soldiers ignored Provoo's low bow but by the next day were using the sergeant as; a' interpreter.

A few days later. Sakakida said he heard Provoo tell a Jap lieutenant again that he was an dained Ruddhist priest and "that would dries to be of any service; they could him." 'The witness testified Provoo produced snapshots of himself in Buddhist robes as a clincher and: that the Japanese officer then told an enlisted man to go ahead and use Provoo." Gets Run of Tunnel After that, Sakakida went on. Provoo had the run of the tunnel. the only American allowed to move about without a Jap guard. Under eross-examination, kida said he.

100. served as an interpreter for the Japs, but he said he did so 011 orders from his American superiors. He also admitted he lied when he told the Japs he was not Ani American soldier but a civilian interpreter attached to the gar-; rison. Those also were his instruc-1 tions, Sakakida testified, because otherwise as a Nisei a son of Japanese parents he probably would have been executed. Four more courtrooms are to be added to the civil division of Municipal court beginning Dec. 1, Judge Joseph H. McGarry, assignment judge of civil cases, said yesterday. Judge McGarry told of this plan in an annual report on the civil division to Chief Justice a Edward S. Jadge Schemer.

His report also disclosed that the civil branch already is well up to date on hearing cases. Election to Full Vacancies The election Tuesday will fill two vacancies, giving the civil branch its full complement of judges. McGarry explained this will permit the organization of 18 civil trial calls. At present, the civil branch has 14 calls, or courtrooms, in operation. Judge McGarry said the civil branch is gaining two other judges for the regular call of cases as a result of the recent elimination of personal property tax hearings in court.

Despite a shortage of judges, McGarry said the civil division in the last four years has disposed of 159,316 contested civil cases. In this period, he pointed out, the court kept pace with 158,955 of current filings and cleaned up a backlog as well. Law Speeds Injury Cases If no more cases were filed. our civil judges could close out all our pending civil cases in six months or less," McGarry said. Judge McGarry said the civil, division is prepared to hear a larger volume of tort cases to as a result of an amendment to state law.

This change increased the jurisdiction of the Municipal court in such cases from damage pleas of $1,000 to $5,000. A decision in a test case before the Illinois Supreme court on the amendment is expected to be given soon, McGarry said. Thus far, he said 300 cases have been filed in Municipal court under the amendment. Traffic Cop Voted 'Most Courteous' Hospitalized Arthur W.
