5B VERMONT NoRTHFiELDPolice scandal Battery Park restoration begins The Burlington Department of Parks and Recreation has started restoring Battery Park in front of the band shell building. It is the second phase of a 1990 master plan program. Restoration work includes installing a brick plaza with raised planting beds and landscaping. Provisions have been made for additional lighting and park benches as well as a landscaped and shaded sitting area. The $30,000 project is funded by Community Development Block grants and other fees.

It is scheduled for completion this fall. Lawyer says state knew witness lied under oath THE BURLINGTON FREE PRESS THURSDAY, JULY 14, 1994 CLAUSSEM'S CLEARANCE SALE New Summer Hours 8 a.m.-6 p.m. Daily BIG SALE ON MOW! ALL ANNUAL FLATS O'Neill had not obstructed justice by telling another officer not to talk about the shooting incident. Valsangiacomo argued that O'Neill and former Northfield officer Mark Heimall were discussing the bad blood between the Northfield and Berlin Police departments not the shooting incident when the chief advised Heimall not to talk about it. State police had wired Heimall to tape the conversation.

The hearings took on an unusual twist when Sleigh tried to subpoena Fisher to get information about the police investigation. At the end of the day, however, Sleigh said he would not need the subpoena as long as he received certain court documents. Trono wore shackles on his ankles throughout the proceedings, inching his way in and out of the courtroom. When the hearing ended, he hugged family members and left in tears. Elwell, with no restraints, sat beside him during the hearing their lawyers on their right.

Falcone sat alone and watched from the public seating area. District Court Judge Shireen Fisher revoked Trono's bail in June, and the Vermont Supreme Court upheld the decision. Fisher did not rule on the latest motion. Oreste Valsangiacomo who represents O'Neill, said he also would challenge Falcone's credibility in the defense of his client. Sleigh, Valsangiacomo, and Elwell's lawyer, Kim Cheney, spent Wednesday arguing for dismissal of the state's charges.

Sleigh and Cheney tried to show discrepancies in the testimony of Raymond Boyce, who was taken into custody New Year's Day. Boyce testified that Trono shot a stun gun into Boyce's sweater-covered chest, then into his bare chest because he refused to spit out his chewing tobacco. "It was an extremely painful electrical shock," Boyce said. "It was excruciating." Sleigh used the stun gun on his own leg. "And you're saying this caused you pain?" Sleigh asked, as if it did not hurt.

Thomas D. Anderson, an assistant U.S. attorney who has been sworn in as a temporary special assistant attorney general, objected to Sleigh's display. Valsangiacomo tried to prove By Andrea Zentz Free Press Staff Writer BARRE State officials knew a key witness against three Northfield policemen lied under oath and failed a polygraph test, a lawyer said Wednesday. Kenneth Falcone became a state witness last month and avoided jail in the Northfield police scandal.

He received a suspended jail term of four-to-six months after pleading no contest to unlawful mischief for firing a gun into a Northfield store in the fall of 1993. Falcone, officers Timothy Trono and Brian Elwell and Northfield Police Chief Michael O'Neill were arrested in March following a Vermont State Police investigation of the store shooting and alleged abuse of a prisoner on New Year's Day. The lies undermine the credibility of Falcone, Trono's lawyer, David Sleigh, said in a motion filed in Vermont District Court on Wednesday. Sleigh said the state knew about the lie detector test and perjury in April, but withheld the information until last week. He argued that the new evidence was grounds for a new bail hearing for his client.

He says the resort does not endanger the scenic beauty of the Mount Mansfield area, contrary to the commission's finding. "I was certainly disappointed. If you go to the Mansfield parking lot and look at the gondola barn, the daylilies planted all around, the mowed grass, the care and cleanliness, it is a tasteful facility which enhances (a visitor's) experience," he said.

Continued from Page IB The District Commission hasn't issued a permit for the rest of the project a new base lodge, wastewater plant and ski lift to connect the Mansfield base lodge with Spruce Peak. But Tuesday the commission did issue "findings of fact," laying out the conditions likely to come with the expansion permit. Among other conditions, the commission appeared ready to ban summertime use of the new lift and new retail shops in the base lodge. Commissioners said they feared the lift would create an "amusement park ambiance" ,,,111 niiiifi'i '-r mmm Picnic and Party Savings at Iffl -fc Hope we have your genes! -ft Wmfbmms (Mm FREE Mug!
