Rutland filmmaker sues over German revenues RUTLAND A local filmmaker is suing an overseas company that he says never paid him nearly $1 million for money his films earned in German-speaking countries.

Edgewood Studios, headed by David Giancola and based in Rutland, sued over three movies it has made, "The Newcomers," "Peril," and "Radical Jack." The seven-page lawsuit was filed late last month in Rutland Superior Court, although the British defendants want it to be heard in federal court. Edgewood opposes that. "I want these people from Great Britain to come over here to explain to a Rutland County jury why they are screwing a Rutland County business out of money," said Sigismund Wysol-merski, a Rutland attorney representing Edgewood. The lawsuit claims breach of contract and breach of fiduciary responsibility. No hearing date has been set in federal court.

The program will subsidize the costs of having dogs and cats spayed or neutered. Persons voluntarily taking advantage of the program will pay a $10.00 co-pay. The procedures will be performed by licensed veterinarians who choose to participate in the program. The goal of the program is to reduce the number of unwanted dogs and cats in Vermont. The veterinarians will be paid from a state fund which was established on July 1, 2004 for this purpose.

The fund is financed by a $2.00 dog license fee surcharge collected annually by the municipalities. Veterinarians will be reimbursed based on a fee schedule established by the Agency. TYPE OF PERSONS AFFECTED: Agency of Agriculture, veterinarians, town clerks, Office of the State Treasurer, dog licensees, persons of low income who own dogs and cats. COST BENEFIT ANALYSIS: Dog and cats owners of low income who choose to participate in the program will have to pay a $10.00 co-pay for each animal. Veterinarians who choose to participate in the program will receive reimbursement payments based on data submitted monthly to the Agency.

The amount of reimbursement will be a sum not to exceed 20 of the statewide average for each covered particular procedure which amount will be established yearly by the Agency. The rule authorizes the Agency to enter into a contract with a person to administer the program. Vermont law was amended effective July 1 2004 to require all dog owners who license their dog with their municipality to fund the program. It is anticipated that reducing the number of unwanted dogs and cats in Vermont will, among other thing, reduce the costs associated with caring for unwanted pets.
