BY ALEX DAVIS Statesman Journal Voters in Marion County were more reluctant than most parts of the state to remove racist language in the Oregon Constitution, election results show. Almost 30,000 voters, or 35 percent of the county's total ballots cast, opposed the plan to delete pre-Civil War wording that refers to "free negroes," and laws based on the number of "white inhabitants" in the state. Cliff Zauner clung to a narrow lead in the only unresolved contest for a Mid-Willamette Valley seat in the Oregon Legislature. Zauner and Komp were separated by just 87 votes of more than in the latest tally from House District 22, which stretches from northeast Salem to Woodburn. Both liveinWoodburn.

When the initial count was completed early Wednesday, the difference was 96 votes. "We knew it would be a close race," Zauner said Wednesday after spending the day picking up his campaign signs. "That's why the district was drawn that way by (Secretary of State) Bill Bradbury." The 2001 redistricting gave Democrats a registration edge of 5.4 percentage points, compared with a Republican registration edge of 3 percentage points in the district Zauner won two years ago. "I think the gap will narrow as more ballots are counted," Komp said. "But I do not know whether I wUl be able to take the seat." Right now, the gap between them will have to drop to about 20 for state law to trigger an automatic recount in the race.

Marion County Clerk Al Davidson said about 9,000 ballots countywide remained uncounted, and only 256 of them were processed Wednesday. He expected many of the rest to be counted today. He said about 6,000 ballots were rejected by the optical-scanning machines, either because the ballots had stray marks or voters marked more than one choice, an "overvote," sure 14, still passed easily. Statewide, opposition had dropped to 29 percent with 91 percent of votes counted as of 2002 Zauner Voters in Washington, Multnomah and Lane counties posted opposition rates of 23 percent each. Deschutes and Clackamas counties recorded 29 percent and 28 percent opposition rates.

The stiffest opposition came from a handful of large but sparsely populated counties in Eastern Oregon. Harney County, for example, passed Measure 14 by just 189 votes, or 53 percent in unofficial results reported Wednesday. Does that mean nearly half of the county's 7,600 residents support racist attitudes? "Heavens no," said Linda Johnson, executive director of the Harney County Chamber of Commerce in Burns. Johnson said the county's large base of conservative, Republican voters probably were skeptical of changing the Constitution for any reason. The theory also might explain trends in the Willamette Valley.

Compared to Eugene and Portland, for example, Salem voters are more conservative. Other counties with higher-than-aver-age opposition Yamhill (36 percent), Coos (41 percent) and Linn (35 percent) also are more conservative. State Rep. Jackie Winters, R-Salem, cautioned against linking the voting results with racist behavior. Winters, an African-American who won her Senate seat Tuesday with 55 percent of the Marion County vote, said the large statewide approval rate for the racist language removal was a triumph, considering there was no official campaign to promote it.

"You're always going to have some that say yea' and some that say said Winters, one of three African-American legislators in Oregon. "We have to get started on the Jan. 28 election." The Zauner-Komp race is among four House districts statewide where the Associated Press had not declared a winner as of Wednesday night. If current trends hold, Republicans will boost their totals in the House from 32 to 35 their highest since the end of the 1999 session and Democrats will drop from 28 to 25.

Republicans swept the other Mid-Valley seats. Rep. Jan Lee of Clackamas, who switched from Republican to Democrat last year, apparently was the only incumbent to lose Tuesday. Rep. Betsy Close, R-Albany, had a narrow victory.

Rep. Elaine Hopson, D-Tilla-mook, was leading her race narrowly. The House will have at least 19 newly elected members, but three have been there before. Republican Randy Miller of Lake Oswego was in the members including Republican Jackie Winters of Salem but only Republican Frank Morse of Albany, who defeated former Democratic Rep. Barbara Ross, comes in without House experience.

Peter Courtney of Salem, elected Tuesday to a second term in the Senate after 14 years in the House, becomes the Senate's senior Democrat. Democrat Joan Dukes of Astoria was elected to a fifth Senate term. Democrats gained one seat to tie Republicans, 15-15, for the first time since the 1956 election. Voters elected all five senators and five House candidates who would have been barred from running under Oregon's term limits law, which the Oregon Supreme Court struck down in January. "That's so tragic," said Marilyn Johnston, coordinator of the Salem Human Rights Relations Advisory Commission. "To know that it's right here in our backyard is frightening." The results were puzzling to Paddy McGuire, deputy secretary of state under Bill Bradbury. McGuire said the measure drew almost zero opposition from the state Legislature, which first proposed removing the language in 1999. McGuire said his office struggled to find two people to represent the opposition point of view on a committee to draft the ballot statement. Both views are required by state law.
