The newspaper said Vermont investigators began looking into Kennedy's conduct in September 1989, after he was stopped by police in Brattleboro for allegedly driving in an erratic manner. There was evidence of drinking in that case, but the patrolman did not seek a breath test and released Kennedy without any charges, officials said. Windham County State's Attorney Dan M.

Davis said that in December 1989 he ordered Kennedy into court on a careless and negligent driving charge after learning about the internal state police probe. Kennedy had been stopped after driving in the oncoming lane on U.S. 5 in Brattleboro, records indicate. Kennedy denied the reckless driving charge and was later found innocent by a jury. Meanwhile, state police determined Kennedy had a Massachusetts license, according to the internal report cited by the newspaper.

Walton would not comment on what he said was a personnel investigation. I V- 1 I I IVj KV- dercover agent and did not need the license for that purpose, the newspaper said. Kennedy last week pleaded innocent to his second charge of driving while intoxicated. According to court records, Kennedy, 37, was found passed out in his private car in Brattleboro in February. Kennedy went to a Florida alcohol rehabilitation center that specializes in police and could not be reached for comment.

In his first drunken driving arrest, the 15-year police veteran was found slumped over the wheel of his cruiser in a Berlin parking lot. He pleaded no contest to the charge in 1988 and was fined $300. Walton said he suspended Kennedy without pay after the latest drunken driving charge. He said state police are conducting an investigation to determine the proper disciplinary action. Kennedy has stepped down as head of the state police union.

The earlier investigation led police to a Greenfield, bar south of Brattleboro on Interstate 91, which is owned by now-retired Lt. David Baker of the Massachusetts State Police. Stephen Kennedy made the license application just weeks before his driver's license was suspended in Vermont for a 1988 drunken driving incident, according to an internal state police investigation reported in the Rutland Herald-Times Argus. Kennedy, who is stationed at the Williston barracks, was promoted by Public Safety Commissioner James Walton to sergeant late last year. But in 1989, Kennedy was the subject of an internal police investigation that he obtained a Massachusetts driver's license under false pretenses. He allegedly listed a Greenfield, bar as his residence and told the Massachusetts Registry of Motor Vehicles that he needed a Massachusetts driver's license to work under cover, according to the report cited by the newspaper last week.
