Th Burlington (Vt.l Free Presi, Tuesday, August 2, 1988 5B Man denies charge of lewd conduct i 't 7 A Shelburne man denied in Vermont District Court Monday a charge of lewd and lascivious conduct with a teen-age boy in Burlington Sunday. Police said they were called by a passer-by who said he saw Eugene F. Lovejoy, 47, fondling a boy in the woods near Rock Point in Burlington shortly after 2:30 p.m. Sunday. Police later discovered Lovejoy and the boy just north of Texaco Beach.

Police arrested Lovejoy after a National Crime Information Center check indicated that Lovejoy was wanted in New Hampshire as a fugitive from justice. The boy said Sunday at North Beach that Lovejoy, whom he had known about one month, asked him if he wanted to walk to the Grand Union on North Avenue, according to a police affidavit. The boy agreed and the two headed north on the beach. When the two reached an area marked "No Trespassing," the boy said he didn't want to continue, but Lovejoy allegedly pulled him by the arm along a wooded path. The boy told police Lovejoy stopped slightly off the path on a rocky ledge near a cliff and began fondling him after saying, "I want to do something to you and if you don't, I will throw you off a ledge." Lovejoy ran off when he saw someone approaching, police said.

The boy went back to the beach and Lovejoy later reappeared and sat near him. Police found the two still sitting on the beach. Lovejoy was convicted of sexual assault on a pre-teen boy in 1981 and sentenced to six to 12 years. He was released in September 1983 when a judge ruled he was inadequately represented at his trial, and never retried because the victim did not want to go through a second trial. Lovejoy also was sentenced to three to four months in August 1986 for prohibited acts and convicted in 1972 on two first-degree arsons.
