Bennett, 76, 205 West Burrell Blairsville, was transported to Indiana Hospital by the Citizens Ambulance Service station in Blairsville following a one- car wreck on North Walnut Street Femco case PUNXSUTAWNEY A preliminary hearing was held here Friday for a third defendant charged in the white collar crime -against the Femco Machine Company, of Punxsutawny. Charged at the hearing held before District Magistrate Guy Lester in the Mahoning East Civic Center here was Patrick Felix. 54. of DuBois. Felix faces 28 charges of forgery in the Femco case which previously resulted in the conviction of one person and a guilty plea by another defendant.

The Femco case has been dormant for several months, reportedly due to the ill health of Felix, the third defendant in the case. Felix was bound over for Jefferson County Court action following yesterday's hearing here. "Felix was originally arrested with two other defedants in the case in May of 1983 and charged with criminal conspiracy and theft by deception. Those two charges were dropped against Felix earlier this month and he was instead charged with forgery. Trooper Harry Funk, of the state police white collar crime unit in Carnegie, filed charges here yesterday Hearing held Friday for white-collar crime contending that Felix signed another person's name on a total of 28 Femco Machine Company checks totaling $28,365.28 in a period between July 15," 1981, and July 8, 1982.

The forged checks ranged in amounts from S500 to $2,300. According to the state police charges, the checks were made out to a ficticious company, called the Wineberg Tool Co. and endorsed by William Wineberg and then cashed at Citizens National Bank in Big Run, Jefferson County. The charges filed yesterday contend that Felix shared the money with Anthony Fernichio, of Punxsutawney. Fernichio earlier entered a guilty plea in the Femco case while a third defendant, Harry Cook, of Punxsutawney, was convicted of theft and conspiracy during a jury trial in June of 1984.

Neither Fernichio nor Cook have been sentenced in the case yet, reportedly pending the outcome of the charges against Felix. At yesterday's hearing before District Magistrate Lester, he ruled that a prima facie case against Felix had been established and to continue his bail which previously had been set at 810,000. He was released on his own recognizance following yesterday's hearing. near Penn Street at 1:57 p.m. Friday.

Bennett is in fair condition today, according to a hospital spokesperson. Blairsville Borough Police say Bennett was northbound when his car jumped the curb on the east side of the street and slammed into a utility pole. Blairsville firemen and a Pennsylvania Electric Co. crew were dispatched to the scene by 9-1-1. Damage to Bennett's car was listed as light to moderate.

Borough police in Indiana reported an accident occurred 1:29 p.m. Friday at the intersection of Nixon Avenue and North Ninth Street. Involved in the mishap were cars driven by Richard Lewis Lucas, 25, of Mclntyre, and Susan Mock, 27, of Indiana. Neither driver was injured and damages were listed as moderate to both cars.
