Under our Constitution, the Congress cannot pass laws penalizing individuals; instead persons who break laws shall have regular trials. This prohibition grew out of the early abuses of Parliament which, for example, condemned the Prince of Wales in 1700, accusing him of betraying the King. It declared that he "be convicted and attained of high treason." IN OTHER years Parliament charged certain subjects with treason, which sometimes involved merely "voting or speaking" out of line. Often it added "corruption of blood," which meant that the doomed person's heirs could not inherit his estate. The English bills of attainder often were directed against persons who threatened to overthrow the government. Thus, many bills were directed against American colonists. By 1789, grown weary of these excessses, the Americans unanimously and without debate denied Congress such powers. Our state constitution, in Article II, Section 25, likewise outlaws any bill of attainder. After the Civil War, for example, some states prohibited lawyers from using the courts unless they swore that they had been and would continue to be loyal to the United states. The U.S. Supreme Court upset these laws. Recently Congress denied salaries to certain federal employes for not cooperating with a congressional investigation. Again the U.S. Supreme Court struck down this law as a bill of attainder. The courts have the power to try, convict and punish accused persons. However, except for impeachment of certain officials, the legislative branch of the government has no judicial power. UNITED NATIONS (AP) The Czechoslovak problem won't be on the agenda, but U.N. headquarters is buzzing with talk that the issue may spark a Soviet walkout during opening debate of the General Assembly's 23rd session beginning Tuesday. In any event, it appears certain that this question and another nonagenda item, Vietnam, will cast a heavy shadow over the three-month session and possibly affect progress on other major issues. Some diplomats fear the meeting may develop into another cold war confrontation reminiscent of the exchanges between Andrei Y. Vishinsky and John Foster Dulles. THE SOVIET Union has shown sensitivity to criticism of its military intervention in Czechoslovakia and has dropped hints of a walkout if U.N. diplomats persist in bringing the question up. The word is, however, that many delegates are going ahead with plans to criticize the Soviet Union during the policy declarations that start the 124-nation assembly. In these genera] statements delegates can deal with any problem whether or not it is on the agenda. One recent example of this is the Vietnam war. Almost every country dealt with it to some extent during debates in the last three sessions, with the Soviet bloc leading the assault on the United States for its Vietnam role. U.N. observers see no way the Russians can avert similar treatment of Czechoslovakia. LATIN • American delegates already have agreed that their foreign ministers will assail the Russians as having violated such U.N. principles as nonintervention and self- determination. It is expected also that Western diplomats will hit hard at the Soviets. The U.S. policy speech is to be delivered by Ambassador George W. Ball, who has taken a leading part before the Security Council in criticizing Moscow's intervention. Secretary of State Dean Rusk, as usual, will be in New York for private talks with foreign ministers attending the assembly session, but he has no plans to address the United Nations. ONE question raised by the Czechoslovak crisis was whether it would prevent or limit the usual talks between Rusk and his Soviet counterpart, Andrei A. Gromyko.
