Ellison heard a similar motion in the case of Gary Schaefer a Springfield man already convicted of killing two Springfield girls, now accused of slaying a third, Sherri Nastasia but has yet to hand down a ruling. During the hearing. Black disclosed that the affidavit does not include a confession from his client, but does have some statements Davis made to police.

By JOHN DONNELLY Th Associated frmu WHITE RIVER JUNCTION A lawyer for three newspapers argued Monday that the sealing of affidavits and issuance of a gag order in the Roger Davis murder case was unconstitutional. Dennis Pearson, representing The Burlington Free Press, The Rutland Herald, and The Valley News of Lebanon, N.H., told District Court Judge George Ellison that he believes the affidavits are public documents and the press, under First Amendment guarantees, has a right to see them. "The press are representatives of the public," Pearson said.

"The question here is then under what circumstances, if any. should the press be excluded from the public record." Davis, a Chester resident, is accused of first-degree murder in connection with the May 19 slaying of his girlfriend, Dorothy Sener. The documents were sealed by District Court Judge Paul Hudson, who is now sitting in another court. Hudson also has sealed the affidavits and issued gag orders in two other Windsor County murder cases. All three orders came within a month.

The newspapers are challenging all three actions, but Monday's hearing dealt only with the Davis case. Pearson said since Hudson did not specify what guidelines he used in his order, the ruling should be "void on its face." The Burlington attorney said Hudson failed to refer in his order to the 1980 guidelines set by the Vermont Supreme Court for closing court documents to the public.
