Amtrak sues Southern Pacific over Sunset Limited service WASHINGTON (UPI) Amtrak, saying it was "sending a message" to the country's railroads, filed suit Thursday in federal district court demanding that the Southern Pacific Railroad operate the New Orleans to Los Angeles Sunset Limited on time. Amtrak president Allan Boyd said the suit, the first ever filed by Amtrak against one of its contracting railroads, charged that SP repeatedly violates federal law on the portion of the route between New Orleans and Houston by giving freight trains priority over Amtrak passenger trains.

Federal law requires that passenger trains be given priority over freight trains except in an emergency. The suit, filed by the Justice Department Thursday in the U.S. District Court for the District of Columbia, demands that SP change its operating procedures to give the Sunset priority and report to Amtrak all passenger train delays of more than 10 minutes with a full explanation for the cause. A spokesman at Southern Pacific headquarters in San Francisco said the suit took the railroad by surprise, and would withhold comment until officials Deaths and Funerals could determine the details of the suit. Amtrak: said it was filing the suit just before Christmas because passenger ridership is expected to be heavy and its riders "will suffer serious delays and inconvenience" without an immediate order.

Boyd said the Sunset was by far the worst operation in the Amtrak system. He said that from July to October of this year the Sunset was not on time even once and consistantly ran six to seven hours late. "It's really sort of pitiful when people call up and ask what day the Sunset gets in, not what hour," Boyd said. Boyd said the suit was "a serious action which we hope will not be necessary in the future." However, he said he hoped the suit would "send a message" to other railroads that Amtrak was "dead serious" about on-time performance. Boyd said the on-time performace of contracting railroads ranges from "very good to very bad." He said the Sunset was the worst, while the "really good" operating railroads were Union Pacific, Seaboard Coastline, Southern Railway, the Milwaukee Road and Conrail.

Amtrak owns all of its locomotives, cars and stations but usually contracts with freight railroads to actually operate the trains.
