Enquirer and News, Battle Creek, Feb. 18, 1972 ABA Cougars file suit ocal mafrnen eye McDanioIs and Sonics I istrict tourneys fled, said the team "wouldn't be too surprised if we remedied the situation." The Cougars took the first legal steps towards that remedy with a suit filed in Los Angeles against an attorney. The situation also roped in McDaniels' alma mater, Western Kentucky University, which said it had no reason to believe McDaniels signed a see action Sunday against Portland. McDaniels, who has been averaging 26.8 points and 14 rebounds a game for the Cougars, declined to outline his reasons for quitting the ABA club. 'The Sonics would say only that he signed a six-year pact.

No other contract details were announced. McDaniels joined Spencer Haywood as the second man to jump from the ABA to Seattle. Haywood, an all-star forward, emigrated to Seattle from Denver last year. The Cougars went to court in Los Angeles, asking $1 million damages and an order stopping Los Angeles attorney Al Ross from allegedly interfering with McDaniels. The Cougar suit contends the former Western Kentucky star first signed with the ABA club in November 1970.

The six-year contract was for $1,357,000 in salary and a turns in 4-1 victory B-3 while John West, Ed Thurston and Dennis Olmstead also are hoping to grab spots. The Class A tourney at Loy Norrix is considered by many coaches to be the toughest in the state. Joining Battle Creek's entries are preps from Jackson, Kalamazoo, Portage, the Lansing aggregations, Grand Ledge, Holt Coldwater, Niles and St. Joseph. At Marshall for the Class apart from the two local teams, are Marshall, Albion, Charlotte, Brooklyn Columbia Central, Eaton Rapids, Lansing Catholic Cen-t a 1 Fowlerville, Haslett, Hillsdale, Jackson Lumen Christi, Mason, Michigan Center, Okemos, Parma Western and Stockbridge.

There will perhaps be a few surprises, some local wrestlers who have not been mentioned may just make. When it comes state tournament time, in any sport, anything can happen. Local coaches are convinced that this is one of the strongest contingencies from the Cereal City's five high schools participating in wrestling, to be competing in the state tournaments. Cady jolts Beaver Cady's Superette jolted Beaver Supply in the inter-c i recreation basketball league action Thursday night at VA Hospital 79-69. In other games, Urbandale Shell won on forfeit from Black Recondos 2-0, and league-leading Douglass community Association beat Carl Angelo's in Kalamazoo 94-71.

Steve Kirkpatrick had game high 29 points for Angelo's while Lonnie Moltimore led Douglass on 28. Chuck Johnson led the Cady upset on 27 points while Andy Howlett contributed 15, Carl English 11 and Harry Shavers 10. Dave Anderson had 23 for Beaver. Junior High results Cereal City wrestlers have excellent chances to advance to regional competition. Harper Creek, bolstered by unbeatens Steve Ferguson (33-0-0) and Brion Smith (31- 0- has entered a 12-man squad which has a combined record of 285 wins, 72 losses and no draws.

Nine of Harper's matmen have lost less than 10 matches this season. Lakeview's strongest hopes rest in the talents of Gary Kunnath (27-10), Randi LaBrecque (25-3-0), Mike Decker (21-7-0) and R.J. Mul-linex (15-8). Meanwhile, Battle Creek is putting all its power into four individuals: Jeff Hersha (24- 1- 0), John Harris (21-3-1), Tim Kellogg (20-4-2) and Don Daniel (12-5-2). The suit also contends McDaniels wanted to renegotiate the contract to spread the salary over 15 years with an additional $50,000 for aggravation.
