CHICAGO TRIBUNE, SUNDAY, MARCH 17, 1968 State Plans Explanation of School Fee Policy A forthcoming clarification of the state's position on public school fees has emerged from a current fight between a citizens committee and the district 23 school board in Prospect Heights. N. E. Hutson, legal adviser in the state public instruction office, said i he plans to inform all county school districts in the state that they may only assess fees for textbook rental, transportation, or a lunch program. Supply Fee Ruled Illegal A special $10 supply fee charged to parents of district 23 pupils.

this school year is illegal, Hutson said. He further clarified his interpretation of state law, saying transportation and lunch fees must be voluntary. If parents not want their children to ride a. school bus or eat in a school cafeteria, they do not have to pay the fee, Hutson said. It is up to each county school district to rescind any illegal fees that now might be assessed, he said.

As for money already paid for illegal fees, residents would have to sue in court for a refund, Hutson said. Part of the impetus for Hutson's recent legal interpretation was provided by Bruce Wallace, a member of the Committee for Better Schools in District 23, who originally challenged the district's supply fee in a letter to Dr. George Gilully. The county official asked Hutson for a legal interpretation. District 23 officials now have agreed to drop the controversial fee next school year, Gilully said.

The county school district cannot ask district 2 23 to return money already collected, he added. "After all, this is not something that has been done with the wrong intent," Gilully said. The school board must decide whether to return the money already collected, he said. Anticipating a legal battle, Robert LeForge, school board president, has remained silent, preferring to work thru Henry Vallely, a Chicago attorney representing the board. Alleges 'Closed Meetings' The board also is facing a complaint from Mrs.

Mrs. Clawes alleges that a' Jan.

27 board meeting in LeForge's home was called without the proper 24 hours notice to members and the newspapers, and that the board conducted regular business in violation of a state law enacted last year. LeForge has said the meeting took place, but denies any law was broken. The board did not discuss Mrs. Clawes' charges at its regular meeting March 4 which was attended by an observer from the state's attorney's office. Office Studies Charges Louis Garippo, the state's attorney who sent the observer, said his office is studying the charges, but he wants to avoid making his office a "tool" in the upcoming district 23 school board elections.

The citizens committee is supporting Wallace as an independent candidate for one of the four school board seats April 13. Mrs. Clawes has also enlisted state Rep. Anthony Scariano in her fight, and he has pledged more legislation to clarify the. open meetings law he helped enact last year.

The law says taxing boards may hold closed meetings only to discuss personnel, land acquisition, youth records, or litigation, and that 24 hours notice must be given on these special meetings. It further stipulates that 10 days notice be given before any regular open meetings are held. Fuel Tax Allotments Decrease Motor fuel tax allotments to northwestern suburbs were less in February than in January, Des Plaines receiving the largest share. The state department of public works buildings reported Des Plaines reived $25,901 of the tax paid into the state treasury during the month. The city was alloted $31,382 for January.

Elgin v. the second ranking municipality with an allotment of $25,217 for February as compared to $30,553 for January. Other northwestern municipatties and allotments reported by the department for February included Harvard, Niles, and Woodstock, $5,053. The city of Chicago received an allotment of $1,810,642 for February, as compared to a $9,193,777 share in January. Jaycees Plan Officer Election The Barrington Jaycees will elect a new slate of officers at 8 m.
