The total kept by all the townships amounted to about $3 million, and Niles was the last holdout. Judge O'Brien ruled last December, in a suit brought on behalf of citizens of Chicago, that it was unconstitutional for 100 per cent of the real estate taxes collected from Chi-cagoans to be turned over to the county treasurer, while the townships turned over only 98 per cent. Upheld by High Court The decision was upheld by the Illinois Supreme Court. Judge O'Brien appointed the bank as trustee in March and ordered the townships to hand over the funds to it. P. nominee for sheriff, reported yesterday that there are persistent rumors about a deal to avoid disclosure of all facts in the trial of Brian Flanagan, accused of attacking State Rep. Richard Elrod last Oct. 11. Elrod's injuries paralyzed him for a time but when his recovery was predicted, he was slated for sheriff by Mayor Daley and other Democratic leaders.

After a series of continuances, the Flanagan case is scheduled for trial Tuesday. Tells of Rumors "Rumors persist and must not be ignored that a deal has been offered by the state's attorney's office to accept a guilty plea to a lesser charge in return for a fine or probation," Carey said in a prepared news release. "The deal is allegedly designed to save the Cook County Democrat machine from the embarrassment which is expected to result from a full scale trial on the merits of all the evidence. "The history of delay and apparent reluctance to bring this matter- to trial gives credence to the persistent rumors reaching my office that the deal has been made by the state's attorney's office. Shies from Politics "Politics should not chart the course of this trial.

It is imperative the case be heard in full and disposed of in a manner that would be in keeping with the highest traditions of justice and respect for our judicial-process. "Recent stories of alleged witnesses to the incident which resulted in the injury to Elrod as reported in newspapers are in direct conflict with official public statements." Last month two "forgotten" witnesses were brought into the case. They said that Elrod crashed into the wall of a building after throwing a flying block into Flanagan during a rampage by the violent Weatherman faction of the Students for a Democratic Society. Flanagan originally was charged with attempted murder but this was changed to aggravated assault. He is free on $100,000 bond.

Finerty IN SHOOTING AT 2 POLICEMEN Edwin Martin, 31, of 5440 S. Prairie was charged yesterday with attempted murder of two Wentworth Avenue policemen. He will appear today in Felony Court. Martin was arrested Wednesday night by Charles Aparo and Raymond Burns, who said he fired a shotgun at them, Martin allegedly fired the shot while running from the policemen, who said they saw him with the weapon near Map Liquors, 327 E. 54th St.

The policemen arrested Martin in a nearby alley after the shot was fired. They said tl.ey did not return the fire. Martin said he was carrying the shotgun because he was looking for a man who had cut him on the arm. UN the 9th District. To keep things mysterious, however, it appears the Republicans will replace him with State Rep. Eddie Wolbank, a North Side antique dealer who was a Democrat until two months ago. According to Fred Zeni, the district's state central committeeman, O'Connor is a mystery because it will come as news to many that he ever was a candidate. Need Yates Opponent Last fall, the Republicans needed someone to run against Democrat Sidney Yates, the district's time congressman.

The deadline for filing approached, but the G. O. P. had not come up with a candidate until Paul Ross, 42d Ward committeeman, talked to Byrne O'Donnell, who talked to O'Connor. O'Connor, a Lake Shore Drive commodities broker, said he would run, and that, apparently, was the last anyone as Ear Reliable Perforating Company, will be held at noon tomorrow in the chapel fit 5303 N.
