Can you borrow from your business? From your perspective, a loan from your company probably seems like a convenient source of temporary (and tax-free) cash. But from the IRS's suspiciously like dividend or salary payments, IRS would like to tax.

perspective, "loans" from companies to their, shareholders often look When examining shareholder loans, the IRS tries to distinguish between legitimate loans and salary or dividend payments which are merely disguised as loans. Here are some tips to help make sure your shareholder loans stand up to IRS scrutiny: Establish a formal, written policy for making loans to employees. Do not favor shareholders over nonshareholders. Document all employee loans with formal, written agreements. Make sure all loans require regular payments with market rates of interest.

should make all loan payments on time and in full: this is probably the single most important factor in defending a shareholder loan against IRS attack. The company should obtain collateral for loans when appropriate. Each shareholder loan should be shown as a receivable on the company's books. Before arranging a shareholder loan, it's best to see your accountant. Your accountant can also advise if there are state tax laws specifically governing (or restricting) shareholder loans.
