r-w bonds for Mrs. Dilling, the Win-retka author of the "Red Network" ard head of an organization known as the Patriotic Researcn bureau. She has been free on S5.000 bond and it was presumed she will remain at liberty on the same bond. The transcript of the commission-er's hearing was 150 pages long, and shortly after the morning session of the hearing before Judge Holly began, he adjourned it to secure time to read the record. Stewart, at the morning hearing, attacked the indictment from the beginning.

Attacks Jury Legality. "This indictment was returned by a grand jury impaneled in July of 1-41." Stewart said. "It was a special jury to investigate sedition and it was continued time and again to consider a matter investigated In its trst session. It cannot, under the law. consider anything other than what was presented at its first session.

"This jury was convened several months before we entered the war. How then could it possibly consider thecal ions that Mrs. Dilling to undermine the morale of the armed forces and to obstruct the war effort, when we were not yet at wart-Mrs. Dilling attempted to speak at this point, but was cut off by William Powt-r Maloney. special federal began to give his side of argument.

When Maloney left the courtroom adjournment of the morning esion. he glanced at a group of 50 v. orr.cn followers of Mrs. Dilling. he said: "1 wonder where their washboards Strategic Retreat.

During the afternoon session of the anr.g Maloney objected to Stew-art reference to Washington.

Stewart replied that he had been speaking only in the larruage of legal terminology and In the term "foreign" he was using an expression well known to lawyers and had meant no offense. said the government had iiit-onal information against Mrs. D.Iar.g in addition to the two charges contained in the Washington, D.

indictment. He accused Stewart cf "blowing hot and then cold in his arguments after Stewart referred to the recent trial of the 8 Nar: saboteurs, who. he said, had been given a fair trial, but doubted that his client could receive the same kind of impartial hearing in Judre Firm In Belief. Afer Judjte Holly had handed his decision Maloney asked the ro-jrt: "Won't you change that about the doubts as to her guilt?" No." Judge Holly replied. "I have Trore than doubts about her guilt.

This does not mean, however, that I arr. not violently opposed to her beliefs. If I were free to exercise my discretion I would grant the writ of hsreas corpus. But the court has no authority to inquire into the validity of the indictment. If I had the power I would be inclined to use it." Attorney Stewart said that the government's insistence that Mrs.

tried in Washington would place her in a perjured atmosphere, witnesses convicted of seditious crimes would be called to testify as witnesses." He said the government had failed to show a probable cause for his client's removal to a foreign state," and that the move would require Mrs. Dilling to take 1hre vans of records to the capital "to support any statement she had made- aeainst persons some of them whom khe has probably cndd Argue Over Thrace. In his answer. Maloney said: "As citizen. I feel deeply hurt over Mr.

Stewart's reference to Washington as state. Washington is certain- the home of any of us." Maior.ey's objection was characterized by Attorney Stewart as "another example cf word distortion and misconstruction by the government In the case. The phrase. foreign state," he said refers to any state or jurisdiction other than the one in which a person happens to be. At the conclusion of the hearing 50 women followers of Mrs.

Dilling rushed forward to tell the erstwhile rrusad-r that she had won a "moral which left Mrs. Dilling in The Washington trial of the 28 indicted there, including at least three Chicapoans. is expected to be held sometime late in October.
