Geisse retired early last year as chairman and chief executive officer. The company was then sold to the Wal-Mart Corp. He is survived by his wife, Mary; sons Larry, of Huntington Beach, Tim, of Chagrin Falls, Ohio; Tom, of Indianapolis; Andy, of St Louis, and John, of San Rafael, daughters Nancy, of Flint, Kathleen, of Tokyo; Sally, of Altadena, Amy, of Davis, and Terry Dunagan, of St.

Louis; a sister, Nancy Falls, of Red Wing, and 15 grandchildren. Service's will be held Tuesday in Indianapolis. Memorials to Little Sisters of the Poor in Indianapolis are top job. "I felt it was my baby, quite frankly," he said in a 1986 interview. In 1968 he moved to St.

Louis, where he opened and ran the Venture Stores, a discount division of the May Department Stores. In 1976, he bought a small discounter in Indianapolis called Ayr-Way. After running Ayr-Way for a couple of years, Geisse sold the business and became a consultant. In 1982, he founded the Wholesale Gub in Indianapolis. The company, a no-frills, low-margin operation, sells merchandise ranging from food to tires.

Its customers are businesses, churches, schools and other nonprofit organizations that pay a $25 annual membership fee. He opened five Wholesale Club tors are told to retreat when threatened, but that can be difficult because farms are isolated and inspectors often are deep into a property before they encounter anyone, Oemichen said. Arguments for special penalties to protect them invoke two legal concepts, Frase said. One is that there are particularly vulnerable victims, in this case occupationally vulnerable. The other is that harming some individuals harms society, in this case by standing in the way of safeguarding milk or the environment.

"We want those people to do those things, and they would be discouraged if they were vulnerable to attack," he said. Setting up categories of victims who get special protection is common, and many states go farther than Minnesota, Frase said. In some states, for example, the death penalty is invoked more readily against people who kill police officers. The practice has been challenged on the ground that it violates the constitutional guarantee of equal protection under the law. But such challenges rarely succeed, Frase said.

"Courts generally say that the legislature has broad discretion to make distinctions" among victims, he said. penalty for such assaults from a misdemeanor, which can bring up to 90 days in prison and a $700 fine, to a gross misdemeanor, which means up to one year in prison and a $3,000 fine. Currently, there are extra penalties for assaults against five categories of people, said University of Minnesota law professor Richard Frase. They are peace officers, firefighters and other emergency medical workers, correctional employees, school officials and victims of bias crimes. In a letter explaining his veto of the bill, Carlson dubbed it "a victim discrimination" bill.

He took issue with the very concept of special protection. "Is it really more heinous to strike a dairy inspector than to strike an insurance salesperson?" he asked. "Is it a greater crime to knock down a physical education teacher than to knock down an 80-year-old grandmother? An assault is an assault. The occupation of the victim should not alter the nature of the crime." Oemichen argues that there is a difference. Ordinarily, people can take steps to avoid dangerous situations, he said.

State law allows agriculture inspectors to enter private property without giving prior notice to a resident, said William Oemichen, an agriculture department attorney. Unannounced visits often are necessary so that problems won't be hidden. Abernathy hasn't been the only inspector to leave a farm at gunpoint.

In 1990, the agriculture department suspended permits for milk sales from the Roger Zavoral farm near Hutchinson after two dairy inspectors said the Zavorals had driven them from the farm with a rifle. Zavoral insisted last week that he and his wife pointed a camera not a gun at the inspectors. But on May 10, 1990, Administrative Law Judge Marlene Senechal rejected that version of the incident as "not credible." Without permits, the farmers had to dump about $10,000 worth of milk, Zavoral said. After 30 days, the Zavorals agreed to report to the McLeod County sheriffs office whenever inspectors were en route to their farm, and the permits were reinstated. They also were required to sell all their firearms.

Now the sheriff accompanies inspectors to the farm, Zavoral said. It's an uneasy truce. Zavoral still condemns inspectors for everything from wearing dirty shoes to driving on his lawn. "If they would act decent and look decent and treat people the way they should, they wouldn't have any of these problems," he said. While rare, assaults on inspectors are increasing, Agriculture Commissioner Elton Redalen told legislators last year.

He urged them to raise the John F. Geisse, 71, a former Dayton's executive who helped start Target stores three decades ago and went on to found the Wholesale Club warehouse buying clubs, died Friday at his home in Indianapolis, apparently of a heart attack. Geisse was born in Madison, Wis. His father, John H. Geisse, was an aviation pioneer and had been director of the development section of the Bureau of Air Commerce, the predecessor of the Federal Aviation Administration.

The family moved to Washington, D.C., when Geisse was a child. He graduated from the U.S. Naval Academy in Annapolis, in 1941 and was on active duty throughout World War II. He retired from the Navy in 1947 as lieutenant commander of the Tuscaloosa. Geisse moved to Minneapolis in He joined Dayton's as a notions salesman and eventually moved up to divisional merchandise manager.

By 1961, he was a vice president. i The owners of the department store had watched other discount stores struggle and grow during the 1950s. They, asked Geisse, who had been thinking about opening his own discount operation, to help develop a concept for the Target stores. The first four Twin Cities Target stores opened in 1962. Target has since become a multibillion-dollar operation, with more than 225 stores.
