Canada work against speedy trials. "To me, the important issue is that the two senators develop a process so that we can get this vacancy filled as soon as possible," he said. Gardebring had been recommended in October for the judgeship held by District Judge Diana Murphy, who was elevated to the U.S. Eighth Circuit Court of Appeals. Another seat on the U.S.

District Court has been vacant since August 1992, when Judge Donald Alsop took senior status, hearing some cases, but opening the seat for appointment. It was for that seat that Wellstone recommended Alexander. Alexander's problems were partly political. She billed herself in her application documents as a "judicial activist." But Gardebring eschewed that description. In a Star Tribune story published in March, Gardebring said her high-court colleagues "would say that I'm quite conservative in my views of what a judge should do." In that same story, she said she did not intend to withdraw her name.

"I would not have agreed to accept this nomination if I didn't think I was well qualified, whether viewed from a Republican or a Democratic perspective." Indeed, Gardebring had support among some Minnesota Republicans, including Gov. Arne Carlson, Rep. Jim Ramstad and former Sen. Dave Durenberger. Gardebring, 48, was a member of the Minnesota Court of Appeals before being appointed to the Supreme Court in January 1991 by DFL Gov.

Rudy Perpich. Before that she served in several capacities in the Perpich administration. She is an honors graduate of Luther College in Decorah, Iowa, and earned her law degree from the University of Minnesota. After Alexander withdrew her name from consideration, Wellstone recommended John Tunheim, the chief deputy state attorney general. That candidacy appears to be moving forward, and the president is expected to nominate Tunheim.

Asked Friday if Grams opposes Tunheim, Hong said, "Not to my knowledge." Wellstone has been successful in Continued from page 1A Gardebring is the second person whom the liberal Wellstone has recommended for a federal judgeship to withdraw from consideration in the face of perceived opposition from Republicans. Earlier this year, Hennepin County District Judge Pamela Alexander withdrew from consideration for the federal bench after her recommendation by Wellstone languished for two years without White House action and amid growing concern that her nomination would be opposed by the new Republican majority in the Senate. In a separate statement Friday, Gardebring said that Grams told the White House he opposed her candidacy but that he never met with her to discuss any concerns. "Under the rules of the Senate, his position will be afforded great weight in the confirmation process. Therefore, any confirmation process would likely be difficult and extended, drawing significant time and energy away from my primary responsibilities on the Minnesota Supreme Court," she said in the statement.

Grams spokesman Peter Hong confirmed Friday that the senator never met with Gardebring regarding the judicial appointment. But Hong would neither confirm nor deny that Grams opposed Gardebring or that he told the White House he would not support her nomination. "It was her decision to withdraw from the process. We respect that decision, and that's it," said Hong. Pressed on whether Grams opposed her and snuffed his Senate colleague's choice for the federal bench, Hong replied, "I don't know how to make it more clear.

She withdrew. Case closed." Wellstone, like Gardebring, asserted that Grams opposed her candidacy. "Senator Grams has expressed to the White House his intention to block Judge Gardebring's nomination to the federal bench," he said in a prepared statement. "I have said all along that it would be a huge disservice to Minnesotans if this nomination were to be blocked." Michael Galvin, who stepped down Friday as president of the Minnesota Bar Association, expressed concern that two of Minnesota's seven federal judgeships will remain vacant. Galvin, who personally supported Gardebring, said the continuing vacancies increase the backlog of cases in the federal court system and 1 FURNITURE MARKET Located 4 12 miles East of 1-35 on Hwy 50 20730 Holyoke Lakeville 612469-4111 DOWNTOWN LAKEVILLE Let the hunt begin.
