The past has cast a long shadow on the yellow brick factory that both men are claiming and on the fate of the company's 385 employees. The Nazi Reich forced Garbaty's father to sell his family's cigarette factory and flee Germany in 1938, penniless. Koerfer's father, a Nazi entrepreneur, was the "Aryan" designated to buy the lucrative firm as a 36th birthday present from his friend Joseph Goebbels, Hitler's henchman. The Koerfers lost the East Berlin plant when the Communists took it over after the war as "People's property." But a closer look reveals that the shadows of the past have been used to obscure the real threat to the fac-; tory's future from today's profiteers of German reunification. R.J.

The case sheds a harsh light on the agency in charge of privatizing indus-; try in what used to be the German Democratic Republic. In this in-' stance part of a larger pattern of mishandled deals by the agency trust officials are turning a profitable factory into a piece of jobless real estate speculation. Unless a buyer is found, the plant will close. In a classic example of scapegoating, 1 trust officials tried to blame the Jewish claimants Garbaty and his 86-, year-old aunt for the trust's mis- takes or misdeeds in the case, stirring ugly anti-Semitic feelings among the threatened factory workers. The final twist came this month when Koerfer, whose father was the beneficiary of the Garbatys' victim- ization, derailed an attempt to revive the Reynolds deal with his own claim of ownership.

"One has to see only the facts, not just the emotional side, which I know as a historian, is very heavy," said Koerfer after his claim surfaced when he tried to stall the second round of Reynolds negotiations. Though he acknowledged that his claim could not succeed by itself under the unification treaty property taken between 1945 and 1949 is not covered he said he believed that his documents could kill the Garbaty claim.

He showed a 1952 settlement under which he is convinced his father repaid Garbaty's father for the factory taken in 1938, with undetermined future payments to be made if German reunification allowed Koerfer to regain the East Berlin plant. "If we cooperate, then we can share the restitution," Koerfer said last month, suggesting a 50-50 split with the Garbatys. Koerfer is mistaken, said Doman, the Garbatys lawyer, citing other documents, including one in which Koerfer's father officially renounced any claim. "Not a word is true," said Nicholas Doman, the Garbatys' lawyer, who stumbled on the newspa-. per story when he came to Berlin last month for his first meeting with trust officials. Far from ever making monetary demands, the Garbatys had no part in any negotiations, confirmed Juergen Freund, chief operating officer of Reynolds in Germany. Freund said the trust not the Garbatys, abruptly refused to sell the factory outright in September, then offered an unacceptable rental scheme, and finally auctioned off the trademark separately, all but dooming the workers' jobs. "We were surprised," Freund said.

"We knew taking the trademark would mean the factory couldn't survive." No one was alarmed that the Garbaty heirs in the United States Garbaty, a professor of Old English at the University of Michigan, and Marie-Louise Garbaty, an elderly widow in New York City filed for restitution in August, after impending German unification opened the door to claims. A law passed by the East German Parliament in June to save jobs and encourage investment gave the trust agency the right to sell businesses to investors regardless of such claims, which were to be compensated later with money from the government That measure, written into the Ger-' man unification treaty in September, was invoked by the trust in numerous other deals to indemnify buyers against conflicting claims. In any case, the Garbatys had no interest in taking possession. "What would I do with a factory?" Marie-Louise Garbaty said. But in October, workers at the plant learned that the Reynolds deal was dead and that the factory was to close at year's end.
