OBITUARIES Wednesday, March 11, 1992 5C (The CTTftiuUlfNras School board warned on prayer Plan would shift responsibility of magistrate recommendations By Jeannie Faris News Capital Bureau COLUMBIA A lawyer for the Department of Education told state board members Tuesday their resolution encouraging silent meditation in South Carolina public schools would be an unconstitutional effort to return prayer to the classrooms. So, too, would be a bill in the Legislature to require a minute at the start of the school day for voluntary silent prayer, said lawyer DaleStuckey. The Board of Education's resolution is set for a key second vote at the Wednesday board meeting. Ms. Stuckey told board members Tuesday the mention of religion in the resolution's preamble, and a December vote to encour- age silent prayer, would work in tandem to show that they intended to put prayer back into classrooms.

And that, she said, would be unconstitutional. Critics have said such efforts by the board or the Legislature would open the door to misinter-pretation and abuse in the schools, regardless of the sponsors' good intentions. Already, Ms. Stuckey said, her office has fielded parents complaints. She encouraged the board to wait until the U.S.

Supreme Court has ruled on the issue in a Rhode Island case, which was argued in November. ty's three state enators, would put Senate District in the downtown area. Reese has been an outspoken critic on the way the present Magistrate's Office is run, particularly with Chief Magistrate Ed Overcash in charge. Overcash is the chief city and chief county magistrate. The chief justice of the state Supreme Court has final approval over appointing the chief county magistrate, while the delegation approves the chief city magistrate position.

Auditor sought for school board The Greenville County school board approved a job description and advertisement Tuesday night in hopes of getting an internal auditor hired by July 1, almost a year after state law required trustees to create the job. Board Chairman Duke McCall said trustees will try to hire an internal auditor before July 1, but it might take that long to take applications and find the most qualified person for the job. State Rep. Lewis Vaughn, an engineer of the requirement to hire an independent internal auditor, said he isn't optimistic. McCall said the board is moving as quickly as it can.

The proposed redistricting changes should not affect this year's magistrate appointments, which have been forwarded to the governor for consideration, Russell and Reese said. Magistrates are appointed for four years. But because the process has been delayed, the next appointments would occur in 1995. Cecil C.
