B-6 Friday, May 7, 2004 Green Bay Press-Gazette www.greenbaypressgazette.com LocalState Fund for Avery collects $3,000 so far to help him get back on his feet. State law provides compensation up to $5,000 for each year someone wrongly convicted was imprisoned, with a cap of $25,000. Avery's claim, expected to be filed soon with the state Claims Board, will be for far more than that based on his lost earning potential, Findley said. Anything more than $25,000 would need approval from the Legislature. "All I can tell you is the legislators who have spoken about this publicly have been talking in the $500,000 range," Findley said.

DNA testing identified the attacker as another man already in prison for a 1995 sexual assault. The donation fund was started a week ago after state Rep. Garey Bies, R-Sister Bay, learned of Avery's living conditions. Avery said he sleeps in the shanty on his younger sister's property in Two Rivers and uses her home to shower and eat meals. "She always tells me I can sleep on the couch," he said.

The shanty is fine as long as the weather is not too windy, Avery said. He had been living at his parents' home near Two Rivers and working in the family auto salvage business, but differences of opinion with his brothers about how to run the operation became too much, he said. Avery said he had no job prospects and spends his days cleaning, doing odd chores and making meals for his sister, her husband and their four children. "I haven't decided what I am going to do," he said. "Maybe auto body.

I did that for nine years so I know how do that." Avery "pretty much needs everything," Findley said Thursday Findley said 45 people had donated $2,906 to the Avery fund by Thursday afternoon. The largest donation was $1,000, and the smallest $5. Terry Dvorak, 38, of Madison, and her family gave the $1,000. "I felt completely moved and tormented by his story," Dvorak said. "I feel it is our obligation to help this person.

And I think more people need to feel that same obligation. He was very wronged." Dvorak said the $3,000 wasn't much money given Avery's plight and noted 600 donors gave about $23,000 to help a dog run over near Glidden last year. "I love dogs. But you know this is a human being," she said about Avery The Innocence Project, which worked for two years to free Avery from prison, is now working with him to submit a claim for compensation from the state The Associated Press People donated nearly $3,000 in a week to help a Wisconsin man living in an ice shanty months after he was freed from prison after serving 18 years for a rape he didn't commit. Steven Avery of Two Rivers is expected to start receiving the money early next week, said Keith Findley, co-director of the Wisconsin Innocence Project, a University of Wisconsin-Madison program that is administering the donation fund.

Avery, 41, said Thursday the donations were "terrific. I appreciate that a lot." He said he probably would use the money to look for a place to rent. His finances were tight, he said. "I got a couple of dollars that I borrowed from my sister." Avery was released from prison last September. He was convicted in 1985 after a woman mistakenly identified him as the man who attacked her that summer on a Lake Michigan beach.

Boldt heard two days of testimony that ended Thursday on a Ti8 UP TO 60 OFF Door County request from Milwaukee-area developers for a permit to build the marina. The de UP TO 70 OFF i.59 the piers if they are moved when the largest ships 1,000 footers are scheduled to come by. Hanaway said the U.S.

Coast Guard was notified of the project and didn't express any concerns about navigation. One neighboring property owner, Daniel Olson, held up a map that showed the piers extending far into U.S. Army Corps of Engineers dredging zones. The marina also requires permission from the Army Corps, which has been asked to scrutinize the marina's impact on dredging areas and snipping lanes. Boldt said he would consider issuing the permit, denying the permit or issuing it with further conditions.

The DNR has already recommended a number of conditions, such as making the marina operators responsible for patrolling trash and weeds that might build up along the piers, and requiring the marina to shorten its piers if a second downtown bridge is built. or to the Door County Circuit Court. The DNR supported the marina throughout the hearing. Objections came mostly from nearby neighbors and people concerned that the marina's 614-foot main pier might someday be an obstacle in the shipping lane if a second downtown bridge is built. "I don't think this project will increase pollution or those types of concerns," DNR water management specialist Mike Hanaway said.

"Nor do we think the public rights of access will be diminished. In fact, we think the public access will be enhanced." Two major issues emerged during the hearing impact on neighbor's access to the water and impact on navigation in the shipping lane. The marina's three piers would stop about 80 to 90 feet short of the current shipping lane. Hanaway said that buffer should be enough to prevent problems with ships entering the bay. He said boats could park temporarily on the ends of remainmq items velopers, Ted Bal-istreri and Peter Moede, are working with marina operators Bay Marine of Sturgeon Bay.

The testimony included praise for the marina, requests for restrictions on its construction and protests from neighbors that it will impede their access to the water.
