"We expect Judge Arnason to grant Miss Davis bail," defense attorney Margaret Burnham told a news conference. "We will not ask for and we will fight any delays for the Feb.

28 starting date. We want to go to trial Feb. 28th." Miss Burnham said Friday's decision striking down the death penalty as unconstitution al California was "a tremendous release for the defense." "It means we no longer have to death qualify the jury," said the attorney. "To death qualify a jury makes it a prosecution prone jury." ane was referring to a process wnereoy the prosecution, which earlier indicated it would seek the death penalty for Miss Davis, explains capital punishment to the jury panel and then attempts to eliminate jurors opposed to it. The former UCLA philosophy instructor was charged with supplying some of the guns used in a Marin County courtroom escape attempt and shooting 1970 in which judge and three others died.

Miss Davis said the court's decision on the death penalty would "shake this states judicial system to its very roots with the loss of its most terrible weapon." We welcome the end of legalized murder but caution that the fight is not over," Miss Davis said in a statement, "jnow we must oegm to win freedom for those like Leslie Wells who faces life imprison- ment without possibility of parole." Wells was one of the first prisoners in the state to be sentenced to death under section 4500. of the state pena code. The section gave automa tic death penalty to a prisoner who assaulted a non-inmate Wells had assaulted a guard but was later granted executive clemency. A statement from Miss Davis' defense committee read "For Angela Davis, the decision means she is no longer charged with a capital crime and must be granted bail. To have Miss Davis out on bail will be a major step towards guarantee of a fair trial and an end to the excessive security measures that have been a presumption of guilt." A spokesman for the group said that they would meet any bail the judge might set.

"We have commitments from Aretha Franklin and other people who will provide the money for her freedom, me spokesman said. Arnason has set Wednesday for the bail hearing, saying if it is worth as much as $100, you don't raise it for the grocer's poultry department. It's a hobbv that requires a great deal of dedication, however, since you can't develop prize birds overnight, he said. Breeders try to attain birds with the shape, color and other characteristics considered ideal in the breed. A licensed judge will handle and examine each bird in the show, and a point-system will decide how the trophies are handed out. The top award, designated "Champion of the Universe," will carry a $100 prize and trophy in the $500 cash show, according to a club member.
