6 oz. h'J Tussy A man listed as Roy Kelley, arrested Saturday night after a chase in which a highway patrolman was shot, yesterday was charged with assault and battery with intent to kill and with operating a car while under the influence of liquor (third offense). Magistrate Bates Aiken issued the warrants, which were signed by Patrolman W. C. McMillan.

The assault and battery warrant alleged that Kelley shot J. C. Neal a highway patrolman, with a pistol. Kelley's address was listed by officers as Pelzer, Rt. 2.

Patrolmen McMillan and Neal chased Kelley in separate cars. They forced him to stop near the Ware Place on Augusta Road, the officers reported. Patrolman McMillan said he started chasing Kelley a few miles from Piedmont. McMillan said that several times he pulled alongside the 1947 Chevrolet driven by Kelley and that each time Kelley "poked a pistol out of the window." Patrolman Neal joined chase. Both patrol cars blocked Kelley's car off near the Ware Place.

Patrolman McMillan said that Kelley came out of his car with a .32 pistol blazing. Patrolman Neal was shot in the arm.
