Greenville. S. C. it: Attorney For Looper Contends, That Chief Executive of City Can Not, Judicially A NOVEL POINT IS RAISED The legality of a sentence passed i by H. C.

Harvley, mayor of Greenville, while presiding over the city court a few days ago in the absence of the city recorder, will be tested in the court of general sessions at its November term. A. J. Looper, tried and convicted in the city court several days ago of violating the ordinance with reference to operating a public service automobile without a license, and sentenced by Mayor Harvley, acting recorder, has filed, through his attorney, T. C.

Turner, notice of his anneal to the circuit court nn the (rmnnil that thfl niavor was without authority in acting as the city court's presiding officer, the mayor's office being an executive one and not judicial. The constitution provides, the appellant alleges, that there shall be three branches of government: legislative, executive and judicial, and that a person holding an office In one branch cannot exercise the functions of an office In either of the other branches. Since Mayor Harvley, the appellant alleges, Is an executive officer, he cannot, under the law, preside over the city Court, the recorder's office being purely a judicial one. The convicted man will appeal to the circuit court to set aside the sentence imposed upon him by Mayor Harvley, alleging that "the said acting recorder was totally without jurisdiction to hear and determine the above stated case, and the findings and sentence imposed is, therefore, null and void." The question involved is a novel one, and the decision of the circuit court will be awaited with interest by many. The Garing Today. Secretary of War May Visit This City Soon Secretary Beaman of the Chamber of Commerce yesterday afternoon telegraphed Secretary of War Baker's private secretary asking him if Secretary Baker would visit Greenville during his week-end visit south. He Is to be, in Charlotte today, and the Chamber of Commerce several days ago invited him to visit Greenville and Camp Sevier, but so far have heard nothing from him. Mr. Beaman experts to hear from the private secretary this morning, and in case Secretary Baker has planned to come here, some function will be arranged in his honor.

Derieux On His Way To France For Duty Friends of James C. Derieux, former managing editor of The News, learned yesterday that he has sailed for France where he will engage in Y. M. Cf A. work near the trenches.

It is understood that he did not know Just in what locality ho would be as-sighed to duty. He was recently in Columbia, visiting his parents, Dr. and Mrs. W. T.

Derieux. 230 Students Are Enrolled At Bailey Gli RKVWO Oct. 5. The Bailey Military academy has a total of 230 utudent this session, 20 8 of whom are boarding in the institution's barracks, and 32 day students. In addition to this 94 have been turned awav because of inability to accommodate Lhem.

Three of a Kind Constituted Notable Exhibit of Green- ville Product At Locust HUSKY AND HANDSOME Among the various wonderful ex hibitions to bo seen at the Locust Agricultural Fair, which closed yesterday afternoon, after two days show, was something entirely out of the ordinary, and not on the program at all. Mr. and Mrs.

John Bishop, whose home is near Greer, in Greenville county, were the center of attraction for the large crowds who were so fortunate as to attend this fair, on account of the fact that their triplets, three well developed, magnificent specimen of young Americans acompanied them, and these three beautiful, round-faced, brown-eyed, three-year-old boys, each weighing exactly 31 pounds, seemed pleased and charmed with the throngs who gathered around them and asked them questions. The names of the three boys are: Frank, Fred and Furman. and the good mother stated that she had no difficulty whatever in distinguishing one from the others. She is the happy mother of five boys and two girls, the youngest being nine months of age, and there is little doubt but that she enjoys the distinction of being the only mother in Greenville county with three bright, beautiful, healthy sons, all the same age. K. W. AT THE COLONIAL "FAIR AND Monday, October 8th. Selwyn Company will present their newest big success, "Fair and Warmer," whose fame has spread all over the country on the strength of its year-long run of unprecedented prosperity at the Eltinge Theatre, Xew York, and an almost equally long run at the Cort Theatre, Chicago, at the Colonial on Monday, Oct. 8.

Avery Hopwood, author of this farce classic, is also author of 'Seven Days" and "Nobody's Widow" and started the long-run-farce on the career it has never since abandoned. So Mr. Hopwood is fairly entitled to his rank as Americas first master of farce-writing. Selwyn Company, "Fair and Warmer's" producers, have established their reputation as pickers of winners by "Within The Law," "Twin Beds." Margaret Illington in "The Lie," Jane Cowl in "Lilac Time" etc. When they followed this array of successes with "Fair and Warmer," the wiseacres said "Trust the Selwyns." Tn "Fair and Warmer," Avery Hopwood uses just the idea he knows best how to put through its paces a satiric and richly humorous complication arising from the fact that two most respectable young persons try to be wicked without Knowing how, and end by covering themselves with ignominy, while the pair at whom they aimed their wickedness, as retaliation, went joyously Scot free.

"Fair and Warmer" begins in the early evening, stays up all night, and comes to a festive conclusion at noon of the following day, after having disrupted two households, de-vasted one "tame robin," reassorted four people who then repudiute the reassortment, and finally hailed blessings and benedictions upon righteous and uprighleous with an impartial hand. Station Opens At Corner North and Laurens Tiic Greenville Auto Filling Station, under management of Fred S. will this morning open fo business at the corner of North and Laurens streets. The station Is so constructed that automobiles may drive through without reversing and will be supplies with gasoline, all kinds of oil and wat-tcr.

At present the station will In open from 6 o'clock In the morning until 12 o'clock at night but. if there is a demand It will later be kept open all night. It will aso be open all day Sunday. The manager Mr. Antley, is an old Furman man who has recently moved here from his former home nt St Mathews.

He has a wide liOHt of friends and is a likable fellow whom the automobile world will find pleasure In deaing witn. Building and Loan Series Opens Today The twenty-fourth series of Mechanics Perpetual Building Loan association which opened on the first of this month will receive first payments today. This Is the oldest association in Greenville, having been organized in 1906. Series opoo every six months and have paid very large profits in the past, the last maturity having granted a profit In excess of per cent. The twelfth series will mature In December.

More than 300 homes have been built here through their plan. BISHOP RIPLETS 1 Gridiron Season Opens At Riverside Park This Afternoon With Hot-Fought Game ARE EVENLY MATCHED i The lid of the football season of Greenville will be pried loose this afternoon with the game between Fur-man and Wake Forest. Both teams report that they are ready for the fray and a warm contest is expected. I.ast Saturday in Atlanta they both met Georgia Tech and from the scores in those games it would seem that the squads are about evenly matched. Furman's warriors have been hard at work for the entirs week getting ready for this same, and Coach Laval molded together a likely bunch of huskies.

They are by far the fastest team that Furmjn fias had In years and should show their heels to most teams in this State. The game is to be staged in the new Riverside I'ark and no expense has been spared to put the Held in first-class shape. There fs a comfortable grandstand that can car for eight hundred people and a bleachers that will take care of three hundred. One entire side of the field will be reserved for automobiles and no pedestrians tie allowed to stand in front of the machines. The military police will be on hand to preserve order and to keep the crowd in the proper place.

There will no De a record orowd on hand, and it would be advisable for people wishing to sit in the grandstand to be so that they can be assured of seats as there will be no reservations made. A car to the Southern Station will cany you to within two minutes walk to the Park and tncy will run every seven minutes. Automobiles will go under the underpass to the South of the Southern Station and will find themselves at the entrance the park. Soldiers Enjoy Good Food At First Baptist A number of soldiers from Camp Sevier, as well as a great many people from the city, enjoyed the oyster and salad suppers supplied by the ladies of the First Baptist church in the church building last night. It is thought that a big crowd of soldiers will this afternoon and ev-enlns avail themselves of thisc opportunity to get delicious home cooking at thirty-five cents a person.

The ladies may continue to serre dinners nnd suppers on given days for some months. Charming young ladies of the church serve as waitresses, there is good music and everything is done to make the visitor at ease, as well as to fill his inner man full. It is a bright and attractive place to get good food cooked in the old-fasn-ionrd style. Two Matinees to Be Given At Grand Today Two matinees will be given at the Grand thus afternoon and those whose snulnters are not on the blink will see some choice ones. For the five acts of Keith vaudeville are all live wires.

In order to accomodate the demand for seats the management found it necessary to put on two matinees and the first will begin with a reel of Pathe news pictures at 1:45. after which the fun- makers and the other artists will take the board. The second afternoon shn' will begin at 3. Two shows will be given tonight as at 7:45 and 8 clock. Addition Be Built To Poinsett School An addition Is to be built to the Poinsett school building, increasing the space there.

Work will start immediately upon the addition by Skelton and Owens, the city school trustees having authorized the biuld-ing of the addition. The cost will be something over $500, it is stated. Many Bank Accounts Started By Soldiers Many bank accounts have been started in the savings departments of the Greenville banks by soldiers from Camp Sevier, according to a well-known banker. The officers at camp are making efforts to instill thrift into the minds of the men and it eems that the efforts are not fu-ttlu. A large amount of money has been deposited In this manned by the khaki-clad boys within the past several weeks, A goodly amount of money is also sent by many of the soldiers, as Is evidenced by the long waiting line before the money order windows of the post office on Wednesdays, Fridays and Saturday afternoons, when the Sammies are able to visit the city.
